By placing an order or using our services, you agree to these terms, ensuring a smooth and reliable experience for everyone. Please read them carefully.

Artigo 1º: Definições
- “Nós” / “Nos”: Icetubs B.V., com sede em Nieuwpoortkade 16 (1055 XG Amesterdão), registada sob o n.º 87358891, NIF: NL864273952B01, na qualidade de vendedor.
- Icetub: Banheira de alta qualidade concebida tanto para água gelada como quente, destinada exclusivamente a água natural sem produtos químicos adicionados, exceto aditivos aprovados pela Icetubs.
- IceSauna: Sauna de gelo de alta qualidade destinada exclusivamente à terapia de calor e ao relaxamento.
- Produtos: Qualquer Icetub, IceSauna ou acessório relacionado vendido por nós.
- Você: Qualquer parte (pessoa singular ou empresa) que celebre um Acordo connosco ou receba uma oferta nossa ao abrigo destas Condições.
- Consumidor: Pessoa singular que adquire um Produto para uso pessoal e não comercial. Na qualidade de Consumidor, estas Condições são aplicáveis salvo disposição legal em contrário.
- Uso Profissional e/ou Comercial: Qualquer compra destinada não estritamente a um único lar privado, mas a um ambiente comercial ou profissional (por exemplo, ginásios, centros de bem-estar).
- Acordo: O contrato entre si e nós ao abrigo destas Condições, formado de acordo com os passos do Artigo 3.º.
- Condições: Estes termos e condições gerais, que podemos atualizar ao abrigo do Artigo 20.º.
- Direito de Retratação: Um período de reflexão de 14 dias para os Consumidores (mas não para os não consumidores) para cancelar um contrato à distância sem penalização.
Artigo 2.º: Aplicabilidade destas Condições
- Âmbito de Aplicação: Estas Condições regem todas as ofertas, orçamentos e Acordos —quer através da nossa loja online quer de outra forma— entre nós como vendedor/fornecedor e você como comprador, salvo modificação expressa por escrito.
- Rejeição de Outros Termos: Rejeitamos expressamente quaisquer outros termos e condições gerais. Um desvio pontual não renuncia ao nosso direito de aplicação estrita futura.
- Disposições Inválidas: Se alguma disposição for inválida ou nula, as restantes permanecem em vigor. Substituímos a parte nula por uma disposição que se aproxime estreitamente do seu propósito original.
- Incertezas / Lacunas: Quaisquer incertezas ou questões não abordadas devem ser resolvidas de forma coerente com estas Condições.
Artigo 3.º: Oferta e Formação do Acordo
- Ofertas Não Vinculativas: As nossas ofertas são não vinculativas salvo declaração expressa em contrário por escrito. Uma oferta pode expirar se o produto deixar de estar disponível antes da aceitação. Não estamos vinculados por erros óbvios (por exemplo, nos preços).
- Detalhes da Oferta: Cada oferta fornece informação suficiente para que compreenda os seus direitos e obrigações ao aceitá-la. As imagens ou amostras são aproximadas e não são juridicamente vinculativas.
- Formação do Acordo: Um Acordo é formado quando:
- Confirmamos o seu pedido por escrito, ou
- Começamos a executar o pedido de forma coerente com a aceitação (por exemplo, preparando o envio).
- Aceitação Divergente: Se a sua aceitação diferir da nossa oferta, não estamos vinculados salvo confirmação por escrito. Orçamentos ou tarifas anteriores não se aplicam automaticamente a novos Acordos.
- Contratos à Distância com Consumidores: Na qualidade de Consumidor, o Acordo forma-se assim que aceita e cumpre as condições indicadas. Em caso de aceitação eletroníca, confirmaremos a receita sem demora.
- Medidas de Segurança: Implementamos medidas técnicas e organizacionais para transações eletronícas seguras. Na qualidade de Consumidor, forneceremos detalhes essenciais em suporte durável antes ou no momento da entrega.
Artigo 4.º: Entrega
- Princípio Ex Works: Salvo acordo escrito em contrário, os Produtos são entregues à saída de fábrica (o nosso armazem). O risco/custos são assumidos por si assim que os Produtos saem das nossas instalações.
- Aceitação e Transferência de Risco: Deve aceitar a entrega quando lhe for proposta. O risco de perda, dano ou depreciação transfer-se para si assim que os Produtos lhe sejam entregues, ao seu representante ou ao transportador que escolheu.
- Acessibilidade do Local: É responsabâlidade sua garantir que o local de entrega seja acessível e obter as licenças necessárias. O equipamento especializado (por exemplo, uma grúa) é da sua responsabilidade salvo acordo em contrário.
- Fornecimento de Informação: Só começamos após receber os dados necessários da sua parte. A não aceitação da entrega ou a ausência de instruções pode resultar em armazenamento por sua conta e risco.
- Terceiros: Podemos utilizar transportadoras ou stocks de terceiros para cumprir os pedidos. Em caso de incumprimento de uma data de entrega, deve notificar-nos por escrito e conceder um prazo razoável.
- Responsabilidade por Atrasos: Não somos responsáveis por atrasos devidos a força maior ou instruções incompletas da sua parte. Em caso de falha de entrega (fora da força maior) e se for da nossa responsabilidade, a nossa responsabilidade limita-se à diferença de preço se tiver de comprar um produto comparável noutro lugar.
- Entregas Parciais: Podemos entregar em prestações, faturando cada uma separadamente. Em Acordos faseados, podemos pausar fases subsequentes até que aprove os resultados anteriores.
- Entregas Adiadas ou Divididas: Se adiar ou dividir as entregas ou não recolher os Produtos, o risco transfer-se quando os rotulamos como seus nos nossos registos.
Artigo 5.º: Uso Correto do Icetub e da IceSauna
Esta secção descreve as diretrizes essenciais para a utilização segura e correta do Icetub (banho de gelo) e da IceSauna. O incumprimento destas instruções pode resultar em lesões, danos no equipamento ou perda de reclamações de responsabilidade.
I. Diretrizes Gerais de Segurança (Aplicáveis ao Icetub e à IceSauna)
- Instruções do Fabricante & Conformidade Local
- Siga sempre as diretrizes oficiais de instalação, operação e manutenção.
- A instalação deve cumprir os regulamentos elétricos e de segurança locais. Em caso de dúvida, contrate um profissional qualificado.
- Comportamento do Utilizador & Avisos de Saúde
- Sem Álcool ou Drogas: Não utilize nenhum dos produtos sob a influência de álcool, drogas ou medicamentos que possam comprometer o julgamento.
- Conselho Médico: Pessoas com doenças cardíacas, pressão arterial elevada, problemas respiratórios, distúrbios circulatórios ou outras preocupações de saúde devem consultar um médico antes de usar.
- Supervisão de Menores: Crianças com menos de 16 anos só podem usar o Icetub ou a IceSauna sob supervisão direta de um adulto.
- Cessação Imediata do Uso: Pare imediatamente de usar e procure assistência médica se sentir tonjeiras, falta de ar, dormencia ou desconforto.
- Segurança Elétrica & Instalação
- Utilize sempre uma fonte de energia devidamente ligada à terra e protegida da exposição à água.
- Uso Correto de Cabos de Extensão: Utilize apenas cabos de extensão devidamente ligados à terra e adequados aos requisitos de potência do Icetub.
- Inspeções Regulares: Verifique frequentemente os cabos de alimentação, fichas e componentes elétricos para detetar danos ou desgaste.
- Colocação do Quadro Elétrico: O quadro elétrico não deve assentar diretamente no chão. Deve ser protegido de exposição excessiva à água e idealmente montado na parede abaixo da tomada de energia.
- Colocação & Considerações Ambientais
- Superfície Estável: Coloque numa superfície nivelada e antiderrapante para evitar quedas.
- Ventilação: Em caso de uso no interior, garanta um fluxo de ar adequado para evitar sobreaquecimento, condensação ou esgotamento de oxigénio.
- Riscos de Incêndio e Fumo: Não use chamas abertas, velas ou materiais inflamáveis dentro ou perto de qualquer um dos produtos.
II. Diretrizes Específicas do Icetub
- Restrições de Uso no Exterior
- Precaução abaixo de -5°C: Não opere o Icetub no exterior abaixo de -5°C. Desligue a unidade de arrefecimento e guarde-a no interior.
- Entre -5°C e 1°C: Opere o motor de arrefecimento no modo “automático” 24/7, com todos os temporizadores desligados, para evitar o congelamento.
- Condições Meteorológicas Extremas: Evite o uso durante tempestades, relâmpagos ou condições meteorológicas extremas.
- Uso a Solo: Nunca use o Icetub no exterior sozinho. Certifique-se de que alguém está ciente da sua sessão.
- Qualidade da Água & Manutenção
- Apenas Aditivos Aprovados: Use exclusivamente o tratamento de água AquaFinesse da Icetubs para a manutenção padrão. Evite bromo, sais ou outros produtos químicos não autorizados.
- Mudanças de Água Regulares: Mude a água e os filtros regularmente com base no uso.
- Testes de Água (Para Clientes Profissionais): Ambientes de uso intensivo devem realizar testes periódicos de qualidade da água.
- Restrições de Uso no Interior
- Sem Uso Desacompanhado: Nunca use o Icetub sozinho no interior.
III. Diretrizes Específicas da IceSauna
- Limites de Temperatura & Exposição
- Limites de Tempo: A duração recomendada da sessão é de 15 a 30 minutos com pausas intermediárias.
- Hidratação: Mantenha-se adequadamente hidratado antes e após o uso.
- Consciência do Utilizador: Se se sentir tônto, mal ou com sobreaquecimento, saia imediatamente e arrefecer.
- Colocação & Segurança de Uso
- Condições Extremas: Evite usar a IceSauna durante tempestades, relâmpagos ou ventos fortes.
- Ventilação Interior: Garanta um fluxo de ar adequado para evitar acumulação de calor ou esgotamento de oxigénio.
- Traje Adequado: Use roupas respirantes e adequadas para sauna; evite tecidos pesados ou sintéticos.
- Sem Uso Desacompanhado: Nunca use a IceSauna sozinho.
IV. Assunção de Risco & Isenção de Responsabilidade
- Aceitação Voluntária do Risco
- Ao usar o Icetub ou a IceSauna, reconhece e aceita os riscos inerentes associados à exposição a temperaturas, equipamentos elétricos e segurança na água.
- Sem Responsabilidade por Uso Indevido
- A Icetubs B.V. não é responsável por lesões, danos ou complicações de saúde resultantes de uso incorreto, incumprimento de instruções ou comportamento inseguro.
- Consequências do Uso Indevido do Produto
- Qualquer dano causado por modificações não autorizadas, uso indevido de produtos químicos ou negligência anulará quaisquer reclamações de defeito do produto.
Artigo 6.º: Amostras, Modelos e Dados
- Apenas Indicativos: Os modelos, amostras ou desenhos que fornecemos são aproximações; os Produtos reais podem diferir ligeiramente.
- Modificações de Dados: Podemos atualizar ou alterar catálogos, especificações técnicas ou dados sem aviso prévio; tais materiais não são vinculativos salvo confirmação por escrito.
- Quantidades Mínimas: Reservamo-nos o direito de estabelecer quantidades mínimas de encomenda para determinados Produtos.
- Propriedade dos Materiais: Os modelos ou amostras que fornecemos continuam a ser nossos salvo acordo escrito em contrário.
Artigo 7.º: Pagamento; Juros e Custos de Cobrança
- Prazo de Pagamento: Salvo indicação em contrário, as faturas são pagáveis no prazo de 30 dias a contar da data da fatura, sem desconto ou compensação, para o nosso banco (NL86 RABO 0319 5907 12, Icetubs B.V.).
- Incumprimento: O não pagamento atempado coloca-o automaticamente em incumprimento. Os juros legais acumulam-se a partir da data de vencimento. Em caso de liquidação, falência ou reestruturação de dívida, todos os montantes tornam-se imediatamente exigíveis.
- Disputas de Fatura: Contestar uma fatura não suspende a obrigação de pagamento.
- Avaliação de Crédito: Podemos verificar a sua solvabilidade e, se justificado, recusar uma encomenda ou aplicar condições especiais.
- Reclamações de Fatura: As objecções escritas devem ser apresentadas no prazo de 30 dias a contar da data da fatura.
- Custos de Cobrança: Em caso de incumprimento, são devidos juros legais mais custos de cobrança extrajudicial. Todos os custos necessários mais elevados (incluindo honorários legais) são também da sua responsabilidade.
Artigo 8.º: Alterações em Produtos ou Circunstâncias
- Modificações Menores: Podemos efetuar pequenas melhorias exigidas por lei ou benéficas para a qualidade do produto, desde que não alterem as características essenciais.
- Alterações Significativas: Se surgirem fatores imprevistos, qualquer das partes pode solicitar modificações por equidade. Os custos adicionais devidos às suas ações serão faturados à sua responsabilidade.
- Atualizações de Morada: Deve informar-nos imediatamente por escrito de qualquer alteração de morada.
Artigo 9.º: Cancelamento, Devolução e Direito de Retratação
- Custos de Cancelamento: O cancelamento (total ou parcial) antes da entrega obriga-o a reembolsar os nossos custos razoáveis e quaisquer danos diretos ou indiretos. As encomendas personalizadas não podem ser canceladas após o início da produção.
- Cancelamento de Última Hora: Se cancelar nas duas semanas anteriores à data de entrega acordada, deverá o valor total da fatura.
- Requisitos de Devolução: As devoluções requerem o nosso consentimento por escrito e são geralmente recusadas se os Produtos estiverem danificados, usados ou não estiverem na embalagem original, ou se tiverem passado mais de 30 dias.
- A sua Confirmação: Deve confirmar que não se aplicam proibições ao solicitar uma devolução.
- Direito de Retratação do Consumidor: Os Consumidores têm 14 dias a partir da receita para se retratar de um contrato à distância sem motivo. Se tiver sido efetuado o pagamento, reembolsamos no prazo de 14 dias após receita dos Produtos ou prova de devolução.
- Custos de Envio: Podem aplicar-se custos adicionais de envio ou manuseamento se o Produto for devolvido de fora das nossas áreas de serviço habituais.
Artigo 10.º: Suspensão e Rescisão
- Motivos Imediatos: Podemos suspender ou rescindir o Acordo se:
- Violar condições essenciais e não resolver o problema no prazo de 7 dias após notificação.
- Solicitar falência, liquidação ou cessar substancialmente as suas atividades comerciais.
- A sua situação financeira se deteriorar significativamente, arriscando o não pagamento.
- Não fornecer a garantia exigida ou violar as condições de pagamento.
- Consequências: Podemos reclamar danos e exigir o pagamento imediato de todas as faturas em atraso mais juros.
Artigo 11.º: Reserva de Propriedade
- Propriedade: Retemos a propriedade de todos os Produtos entregues até que liquide todas as obrigações no âmbito de qualquer Acordo connosco.
- Direito de Restituição: Se não cumprir as suas obrigações, podemos recuperar os Produtos sujeitos à reserva de propriedade. Deve cooperar plenamente.
- Reclamações de Terceiros: Deve informar-nos prontamente se um terceiro tentar apreender ou reclamar direitos sobre os nossos Produtos retidos.
- Seguro e Proteção: Podemos exigir que segure os Produtos e nos ajude a proteger os nossos direitos de propriedade.
Artigo 12.º: Conformidade, Inspeção e Reclamações
- Qualidade Básica: Garantimos que os Produtos cumprem os requisitos habituais para uso normal no momento da entrega.
- Inspeção na Receita: Aquando da entrega, verifique se os Produtos correspondem ao Acordo em termos de tipo, quantidade e estado, e anote quaisquer danos visíveis.
- Defeitos Visíveis vs. Não Visíveis: Comunique defeitos visíveis por escrito no prazo de 14 dias após a entrega; defeitos não visíveis no prazo de 14 dias após a descoberta (mas não além de 3 meses).
- Variações Menores: Pequenas variações de cor ou tamanho não justificam uma reclamação.
- Obrigações Durante as Reclamações: Mesmo com uma reclamação atempada, deve pagar e aceitar os Produtos salvo acordo em contrário.
Artigo 13.º: Preços e Aumentos de Preços
- IVA: Os preços cotados excluem geralmente 21% de IVA salvo indicação claramente em contrário.
- Ajustamento de Preços: Nos primeiros 3 meses do Acordo, só podemos aumentar os preços se a lei o exigir. Pode cancelar no prazo de 14 dias se tal ocorrer. Após 3 meses, podemos ajustar os preços por razões de mercado ou de custo.
Artigo 14.º: Responsabilidade e Indemnização
- Âmbito da Responsabilidade: Somos responsáveis apenas pelos danos diretos causados pela nossa negligência grave ou má conduta intencional.
- Sem Danos Indiretos: Não somos responsáveis por danos indiretos ou consequentes (por exemplo, lucros cessantes, interrupção de negócios).
- Indemnização por Si: Indemniza-nos contra reclamações de terceiros não diretamente causadas por nós.
- Limite de Responsabilidade: A nossa responsabilidade é limitada pelo pagamento do nosso segurador.
- Isenções: Não somos responsáveis por eventos de força maior (Artigo 15.º), nem por danos decorrentes de uso em festivais ou ambientes igualmente não controlados.
Artigo 15.º: Força Maior
- Definição: A força maior inclui eventos imprevistos fora do nosso controlo —greves, escassez de matérias-primas, catástrofes naturais, ações governamentais, etc.— que tornam o cumprimento impossível ou desarazoadamente oneroso.
- Invocação Pós-Obrigação: Podemos invocar a força maior mesmo após a data em que devíamos ter entregue. Podemos suspender ou cancelar obrigações sem responsabilidade por danos.
- Cumprimento Parcial: Se cumprimos parcialmente as obrigações antes da força maior, podemos faturar essa parte.
Artigo 16.º: Propriedade Intelectual e Industrial
- Sem Remoção de Avisos: Não pode remover ou alterar quaisquer marcas registadas, direitos de autor ou outros rótulos de propriedade dos nossos Produtos ou materiais.
- Proibição de Imitação: Imitar ou reproduzir os nossos produtos/designs está proibido.
- Penalidades: A violação destas proibições incorre numa multa de 5% do preço de compra do Produto (mín. 500 € por artigo).
Artigo 17.º: Avisos de Saúde e Segurança
- Sem Aconselhamento Médico: Não prestamos aconselhamento médico. Se tiver doenças cardíacas, estiver grávida, tomar medicação ou tiver preocupações de saúde, consulte um profissional antes de usar um Icetub ou IceSauna.
- Restrições de Idade: Os nossos Produtos não são recomendados para menores sem supervisão direta de um adulto.
- Instalação & Manutenção: Deve garantir que a instalação cumpre os códigos elétricos/de construção locais.
- Sensibilidades ao Calor/Frio: A exposição prolongada ou extrema a temperaturas pode ser perigosa. Pare de usar o Produto se se sentir tônto, desfalecido ou mal, e procure ajuda médica se necessário.
Artigo 18.º: Renúncia a Lesões Pessoais / Assunção de Risco
- Riscos Inerentes: Ao usar o nosso Icetub ou IceSauna, reconhece que existem riscos inerentes, incluindo —mas não se limitando a— escorregamentos, quedas, stress térmico/frio, desmaio ou choque. Assume voluntariamente estes riscos.
- Cessação Imediata do Uso: Se sentir sintomas adversos (por exemplo, falta de ar, tonjeiras), pare imediatamente de usar e procure aconselhamento médico.
- Supervisão de Menores: Se for permitido a menores usar o Produto, a supervisão direta de um adulto responsável é obrigatória.
- Isenção de Responsabilidade: Sujeito à lei aplicável, não somos responsáveis por lesões pessoais resultantes do uso incorreto, inseguro ou negligente do Produto.
Artigo 19.º: Privacidade
- Tratamento de Dados: Tratamos os dados pessoais (para encomendas, entregas, etc.) em conformidade com o RGPD e a nossa Declaração de Privacidade em icetubs.com/privacy-statement.
- Atualizações de Política: Podemos atualizar a nossa Declaração de Privacidade; as alterações entram em vigor aquando da sua comunicação.
Artigo 20.º: Disposições Finais
- Alterações: Podemos alterar estas Condições a qualquer momento. As alterações entram em vigor na data comunicada.
- Exclusão de Determinados Artigos: Os artigos 7:404, 7:407(2) e 7:409 do Código Civil Neerlandes não se aplicam.
- Reclamações Legais: Todas as reclamações legais prescrevem 1 ano após o seu surgimento. Aplica-se exclusivamente o direito neerlandes.
- Resolução de Litígios: Os litígios são submetidos ao tribunal competente de Amesterdão, Países Baixos.
- Controlo de Versões: Aplica-se a versão mais recente ou a versão válida no momento do início da relação jurídica.

Article 1: Definitions
- “We” / “Us”: Icetubs B.V., located at Nieuwpoortkade 16, (1055 XG Amsterdam), registered under no. 87358891, VAT no. NL864273952B01, acting as the seller.
- Icetub: A high-quality tub designed for both ice-cold and hot water use, intended exclusively for natural water with no added chemicals, except for additives approved by Icetubs
- IceSauna: A high-quality ice sauna intended exclusively for heat therapy and relaxation.
- Products: Any Icetubs, IceSaunas, or related accessories sold by us.
- You: Any party (individual or business) entering into an Agreement with us or receiving an offer from us under these Conditions.
- Consumer: A natural person purchasing a Product for personal, non-commercial use. If you are a Consumer, these Conditions apply unless otherwise specified by law (e.g., Consumer Rights Act 2015).
- Professional and/or Business Use: Any purchase not strictly for a single private household, but for a commercial or professional setting (e.g., gyms, wellness centers).
- Agreement: The contract between you and us under these Conditions, formed according to the steps in Article 3.
- Conditions: These general terms and conditions, which we may update under Article 20.
- Right of Withdrawal: A 14-day cooling-off period for Consumers (but not for non-consumers) to cancel a distance contract without penalty.
Article 2: Applicability of These Conditions
- Scope: These Conditions govern all offers, quotations, and Agreements—whether via our webshop or otherwise—between us as seller/supplier and you as purchaser, unless explicitly modified in writing.
- Rejection of Other Terms: We expressly reject any other general terms and conditions. These Conditions also apply to all Agreements involving third parties. Deviating once does not waive our right to future strict adherence.
- Invalid Provisions: If any provision is invalid or void, the remaining provisions remain in effect. We will replace the null or voided part with one closely matching its original purpose.
- Uncertainties / Gaps: Any uncertainties or unaddressed issues must be resolved in a way consistent with these Conditions.
- Consumer Rights Act 2015: If you are a Consumer in the United Kingdom, your statutory rights under the Consumer Rights Act 2015 will apply where applicable. If any clause in these Terms contradicts your statutory rights, the Consumer Rights Act 2015 will take precedence
Article 3: Offer and Formation of Agreement
- Non-Binding Offers: Our offers are non-binding unless explicitly stated otherwise in writing. An offer may expire if the product becomes unavailable before acceptance. We are not bound by obvious errors (e.g., in pricing).
- Offer Details: Each offer provides enough information for you to understand your rights and obligations on acceptance. Images or samples are approximate and not contractually binding.
- Agreement Formation: An Agreement is formed when:
- We confirm your order in writing, or
- We begin fulfilling the order in a manner consistent with acceptance (e.g., preparing shipment).
- Deviating Acceptance: If your acceptance differs from our offer, we are not bound unless we confirm in writing. Past quotations or rates do not automatically apply to new Agreements.
- Distance Contracts with Consumers: If you are a Consumer, the Agreement forms once you accept and meet any stated conditions. If accepted electronically, we will confirm receipt without delay; otherwise, you may dissolve the Agreement.
- Security Measures: We implement technical and organizational measures for secure electronic transactions. If you are a Consumer, we will provide essential details (e.g., address, Right of Withdrawal info) on a durable medium by or before delivery.
Article 4: Delivery
- Ex Works Principle: Unless agreed otherwise in writing, Products are delivered ex works (our warehouse). You assume risk/costs once Products leave our facility.
- Acceptance and Risk Transfer: You must accept delivery when offered. Risk of loss, damage, or depreciation transfers to you as soon as the Products are handed over to you, your agent, or your chosen carrier.
- Site Accessibility: You are responsible for ensuring the delivery site is accessible and for acquiring any required permits. Specialized equipment (e.g., a crane) is at your expense unless otherwise agreed.
- Information Provision: We only start after receiving any necessary data from you. Failure to accept delivery or provide instructions may result in storage at your risk and cost.

- UK Import Responsibilities: If you are purchasing from the United Kingdom, you are responsible for paying any applicable import duties, customs tariffs, or local taxes upon arrival. It is your responsibility to ensure compliance with UK product regulations unless we explicitly confirm conformity in writing.
H2: Article 5: Proper Use of the Icetub and IceSauna
This section outlines essential guidelines for the safe and proper use of the Icetub (ice bath) and IceSauna. Failure to follow these instructions may result in injury, equipment damage, or voided liability claims.
I. General Safety Guidelines (Applies to Both Icetub & IceSauna)
- Manufacturer Instructions & Local Compliance
- Always follow official setup, operation, and maintenance guidelines.
- Installation must comply with local electrical and safety regulations. If uncertain, hire a qualified professional.
- User Conduct & Health Warnings
- No Alcohol or Drug Use: Do not use either product while under the influence of alcohol, drugs, or medications that may impair judgment.
- Medical Advisory: Individuals with heart conditions, high blood pressure, respiratory issues, circulatory disorders, or other health concerns should consult a physician before use.
- Minor Supervision: Children under 16 years must only use the Icetub or IceSauna under direct adult supervision.
- Immediate Cessation of Use: Stop use immediately and seek medical attention if you experience dizziness, shortness of breath, numbness, or discomfort.
- Electrical & Installation Safety
- Always use a properly grounded power source protected from water exposure.
- Proper Extension Cord Use: Only use extension cords that are properly grounded and rated for the Icetub’s power requirements. Avoid ungrounded or low-capacity cords, as they may cause overheating or fire hazards. Plug directly into a dedicated power outlet whenever possible.
- Regular Inspections: Frequently check power cords, plugs, and electrical components for damage or wear.
- Fusebox Placement: The fusebox must not rest directly on the ground. It should be protected from excessive water exposure and ideally mounted along the wall below the power plug.
- Water Resistance Limitation: While the fusebox is water-resistant, it is not designed to withstand prolonged submersion or being placed in standing water (e.g., puddles). Ensure proper installation to prevent damage.
- Placement & Environmental Considerations
- Stable Surface: Place on a level, non-slippery surface to prevent tipping or falls.
- Ventilation: If used indoors, ensure proper airflow to prevent overheating, condensation, or oxygen depletion.
- Fire & Smoke Hazards: Do not use open flames, candles, or flammable materials inside or near either product.
II. Icetub-Specific Guidelines
- Outdoor Use Restrictions
- Under -5°C precaution: Do not operate the Icetub outdoors below -5°C. Detach the cooling unit and store it indoors to prevent damage.
- Between -5°C and 1°C: Operate the cooling engine on “automatic” mode 24/7, with all timers off, to prevent freezing.
- Severe Weather: Avoid use during thunderstorms, lightning, or extreme weather.
- Solo Use: Never use the Icetub outdoors alone. Ensure someone is aware of your session.
- Water Quality & Maintenance
- Approved Additives Only: Use only Icetubs’ AquaFinesse water treatment for standard maintenance. Professional clients using the Hanna system provided by Icetubs may use chlorine as needed, following proper dilution and safety guidelines. Avoid bromine, salts, or other unauthorized chemicals, as they may corrode components.
- Regular Water Changes: Change the water and filters regularly based on usage to maintain hygiene and system longevity.
- Water Testing (For Professional Clients): High-use environments, such as gyms and wellness centers, should conduct periodic water quality testing to ensure compliance with local hygiene and safety standards.
- Indoor Use Restrictions
- No Unattended Use: Never use the Icetub alone indoors. Ensure someone is aware of your session.
III. IceSauna-Specific Guidelines
- Temperature & Exposure Limits
- Time Limits: Recommended session duration is 15–30 minutes with breaks in between.
- Hydration: Stay properly hydrated before and after use to avoid dehydration or heat exhaustion.
- User Awareness: If you feel lightheaded, unwell, or overheated, exit immediately and cool down.
- Placement & Usage Safety
- Extreme Weather: Avoid using the IceSauna during thunderstorms, lightning, or high winds.
- Indoor Ventilation: Ensure adequate airflow to prevent heat buildup or oxygen depletion.
- Appropriate Attire: Wear breathable, sauna-appropriate clothing; avoid heavy or synthetic fabrics.
- No Unattended Use: Never use the Icesauna alone. Ensure someone is aware of your session.
IV. Assumption of Risk & Liability Disclaimer
- Voluntary Risk Acceptance
- By using the Icetub or IceSauna, you acknowledge and accept the inherent risks associated with temperature exposure, electrical equipment, and water safety.
- No Liability for Misuse
- Icetubs B.V. is not liable for injuries, damages, or health complications resulting from improper use, failure to follow instructions, or unsafe behavior.
- Product Misuse Consequences
- Any damage caused by unauthorized modifications, improper chemical use, or negligence will void any product defect claims or liability considerations.
Article 6: Samples, Models, and Data
- Indicative Only: Models, samples, or drawings we provide are approximations; actual Products may differ slightly, especially if made from natural materials.
- Data Modifications: We may update or alter catalogs, technical specs, or data without notice; such materials are not binding unless confirmed in writing.
- Minimum Quantities: We reserve the right to set minimum order quantities for certain Products.
- Ownership of Materials: Any models or samples we supply remain ours unless agreed otherwise in writing; those you supply remain yours.
Article 7: Payment; Interest and Collection Costs
- Payment Deadline: Unless stated otherwise, invoices are payable within 30 days of the invoice date, without discount or setoff, to our bank (NL86 RABO 0319 5907 12, Icetubs B.V.).
- Default: Failing to pay on time places you in default automatically. Statutory interest accrues from the due date. If you face liquidation, bankruptcy, or debt restructuring, all sums become immediately payable.
- Invoice Disputes: Disputing an invoice does not suspend payment. Payments first cover accrued interest/costs, then the oldest unpaid invoice.
- Credit Assessment: We may check your creditworthiness. If justified, we can refuse an order or apply special terms. We can also request a deposit or other security before delivery; refusal is a breach.
- Invoice Complaints: Written objections must be lodged within 30 days of the invoice date. Otherwise, we assume acceptance. If you have paid, we consider you to have agreed with its contents.
- Collection Costs: If you are in default, you owe statutory interest plus extrajudicial collection costs per the Dutch Order of Advocates. Any higher necessary costs (including legal fees) are also yours.
Article 8: Changes in Products or Circumstances
- Minor Modifications: We may make minor improvements required by law or beneficial to product quality, provided they do not alter essential features.
- Significant Changes: If unexpected factors emerge—unknown at the Agreement’s inception—either party may request modifications for fairness. Additional costs due to your actions are billed to you.
- Address Updates: You must inform us of address changes in writing immediately. Deliveries to your last known address are deemed delivered.
Article 9: Cancellation, Return Shipment, and Right of Withdrawal
- Cancellation Costs: Canceling (in whole or part) before delivery obligates you to reimburse our reasonable costs and any direct or indirect damages. Personalized/custom orders cannot be canceled once production starts, unless we agree in writing.
- Last-Minute Cancellation: If you cancel within two weeks of the agreed delivery date, you owe the full invoice amount.
- Return Requirements: Returns need our written consent and are generally refused if Products are damaged, used, or not in original packaging, or if more than 30 days have passed. Special-condition or custom items are also excluded.
- Your Confirmation: You must confirm no prohibitions apply when requesting a return. We decide if the Products qualify for credit, exchange, or rejection based on their condition upon arrival.
- Consumer Right of Withdrawal: Consumers in the United Kingdom have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel an order for most Products within 14 days of receiving them. This does not apply to custom-made or perishable goods
- Shipping Costs: Additional shipping or handling fees may apply if the Product is returned from outside our usual service areas.
- Additional UK Consumer Rights: If you are a Consumer in the United Kingdom, local legislation may grant you extra or different return/cancellation rights than those stated here. In case of conflict, those local rights prevail.
Article 10: Suspension and Termination
- Immediate Grounds: We may suspend or terminate the Agreement if:
- You breach essential terms and fail to fix the issue within 7 days of notice.
- You face bankruptcy, liquidation, or substantially cease business.
- Your finances deteriorate significantly, risking non-payment.
- You fail to provide required security or breach payment terms.
- Consequences: We can claim damages and demand immediate payment of all outstanding invoices plus interest. Termination does not affect accrued rights predating termination.
Article 11: Retention of Title
- Ownership: We retain ownership of all delivered Products until you settle all obligations under any Agreement with us. Title passes only after all payments are completed.
- Right to Repossess: If you fail to meet obligations or if we suspect non-compliance, we may reclaim the Products still under retention of title. You must fully cooperate.
- Third-Party Claims: You must inform us promptly if a third party attempts to seize or claim rights over our retained Products.
- Insurance and Protection: We may require you to insure the Products, assign any insurance claims to us, label them as our property, and assist in protecting our ownership rights.
Article 12: Conformity, Inspection, and Complaints
- Basic Quality: We ensure Products meet usual requirements for normal use at delivery. Natural materials (like wood) may shift or crack, which is not considered a defect.
- Inspection on Receipt: Upon delivery, verify that the Products match the Agreement in type, quantity, and condition, and note any visible damage.
- Visible vs. Non-Visible Defects: Report visible defects in writing within 14 days of delivery; non-visible defects within 14 days of discovery (but not beyond 3 months). Late reporting may forfeit your rights.
- Minor Variations: Small color or size variations do not justify a complaint. If a complaint is valid, we may offer a refund, price reduction, repair, or replacement.
- Obligations During Complaints: Even with a timely complaint, you must still pay and accept the Products unless we agree otherwise. Returns are only possible with prior written approval.
Article 13: Prices and Price Increases
- VAT: Quoted prices generally exclude 20% VAT unless clearly stated otherwise.
- Price Adjustment: Within 3 months of the Agreement, we may raise prices only if required by law. You may cancel within 14 days if that occurs. After 3 months, we can adjust prices for market or cost reasons.
Article 14: Liability and Indemnification
- Scope of Liability: We are liable only for direct damages caused by our gross negligence or willful misconduct, subject to the limits in this article.
- No Indirect Damages: We are not liable for indirect or consequential damages (e.g., lost profits, business disruption). For Consumers, these limitations apply as far as Dutch law permits (Article 7:24(2) BW).
- Indemnification by You: You indemnify us against third-party claims not directly caused by us. We are not responsible for any damage that occurs under your control or someone else’s.
- Liability Cap: Our liability is capped by our insurer’s payout. If the insurer does not pay, it is limited to the invoice value of the relevant Product.
- Exemptions: We are not liable for force majeure events (Article 15), nor for damages arising from usage at festivals or similarly uncontrolled environments.
- Mandatory Local Laws: UK law does not permit disclaimers or limitations of certain implied warranties or liabilities. If so, any conflicting limitations in these Conditions do not apply to the extent prohibited by local law.
Article 15: Force Majeure
- Definition: Force majeure includes unforeseen events beyond our control—strikes, raw material shortages, natural disasters, government actions, etc.—that make performance impossible or unreasonably burdensome.
- Post-Obligation Invocation: If these conditions arise after we should have delivered, we can still invoke force majeure. We may suspend or cancel obligations without liability for damages.
- Partial Performance: If we partially fulfilled obligations before force majeure, we may invoice for that portion. Force majeure affecting our suppliers also counts as force majeure for us.
Article 16: Intellectual and Industrial Property
- No Removal of Notices: You may not remove or alter any trademarks, copyrights, or other proprietary labels from our Products or materials.
- Prohibition on Imitation: Imitating or reproducing our products/designs is banned, as is providing them to third parties who might replicate them.
- Penalties: Breaching these prohibitions incurs a fine of 5% of the Product’s purchase price (min. £500 per item). You must enforce this through a chain clause on your successors.
Article 17: Health & Safety Disclaimers
- No Medical Advice: We do not offer medical advice. If you have heart conditions, are pregnant, take medication, or have health concerns, consult a professional before using an Icetub or IceSauna.
- Age Restrictions: Our Products are not recommended for minors without direct adult supervision. An adult should be aware of potential risks before allowing a minor to use the Product.
- Setup & Maintenance: You must ensure installation complies with local electrical/building codes. If unsure, hire qualified professionals to avoid safety hazards.
- Heat/Cold Sensitivities: Prolonged or extreme temperature exposure can be dangerous. Stop using the Product if you feel dizzy, faint, or unwell, and seek medical help if needed.
Article 18: Personal Injury Waiver / Assumption of Risk
- Inherent Risks: By using our Icetub or IceSauna, you acknowledge there are inherent risks, including—but not limited to—slipping, falling, heat/cold stress, fainting, or shock. You voluntarily assume these risks.
- Immediate Cessation of Use: If you experience any adverse symptoms (e.g., shortness of breath, dizziness), stop use immediately and seek medical advice.
- Minor Supervision: If minors are allowed to use the Product (e.g., in a family setting), direct supervision by a responsible adult is mandatory.
- Disclaimer of Liability: Subject to applicable law, we are not liable for personal injuries resulting from your improper, unsafe, or negligent use of the Product. This includes failure to follow recommended instructions and guidelines.
Article 19: Privacy
- Data Processing: We process personal data (for orders, deliveries, etc.) in accordance with the GDPR and our Privacy Statement at icetubs.com/privacy-statement.
- Policy Updates: We may update our Privacy Statement; changes take effect upon communication. We encourage you to review it periodically.
Article 20: Final Provisions
- Amendments: We can amend these Conditions at any time. Changes take effect on the date communicated or upon notification if no date is specified. If you are a Consumer and a significant amendment harms your rights, you may dissolve the Agreement under Article 6:237(c) BW.
- Exclusion of Certain Articles: Articles 7:404, 7:407(2), and 7:409 of the Dutch Civil Code do not apply.
- Legal Claims: All legal claims expire 1 year after they arise. Only Dutch law applies. The Vienna Sales Convention is excluded.
- Dispute Resolution: Disputes go to the competent court in Amsterdam, Netherlands, unless another court is mandated by law.
- Version Control: The latest version or the version valid at the time the legal relationship started applies.
- Legal Jurisdiction: These Terms are governed by Dutch law. However, if you are a Consumer in the United Kingdom, you may bring legal proceedings either in the Netherlands or in the UK courts where you reside, in accordance with UK consumer law.

- Consumer: A natural person purchasing a Product for personal, non-commercial use. If you are a Consumer, these Conditions apply unless otherwise specified by law (e.g., US Federal Trade Commission (FTC) rules and applicable state consumer protection laws).
- Professional and/or Business Use: Any purchase not strictly for a single private household, but for a commercial or professional setting (e.g., gyms, wellness centers).

- Right of Withdrawal: Consumers in the United States do not have an automatic right to cancel an order once placed, except where legally mandated. - Offer Details: Each offer provides enough information for you to understand your rights and obligations on acceptance. Images or samples are approximate and not contractually binding.
- Agreement Formation: An Agreement is formed when:
- We confirm your order in writing, or
- We begin fulfilling the order in a manner consistent with acceptance (e.g., preparing shipment).
- Deviating Acceptance: If your acceptance differs from our offer, we are not bound unless we confirm in writing. Past quotations or rates do not automatically apply to new Agreements.
- Distance Contracts with Consumers: If you are a Consumer, the Agreement forms once you accept and meet any stated conditions. If accepted electronically, we will confirm receipt without delay; otherwise, you may dissolve the Agreement.
- Security Measures: We implement technical and organizational measures for secure electronic transactions. If you are a Consumer, we will provide essential details (e.g., address, Right of Withdrawal info) on a durable medium by or before delivery.

- Ownership of Materials: Any models or samples we supply remain ours unless agreed otherwise in writing; those you supply remain yours.
Article 7: Payment; Interest and Collection Costs
- Payment Deadline: Unless stated otherwise, invoices are payable within 30 days of the invoice date, without discount or setoff, to our bank
- Default: Failing to pay on time places you in default automatically. Statutory interest accrues from the due date. If you face liquidation, bankruptcy, or debt restructuring, all sums become immediately payable.
- Invoice Disputes: Disputing an invoice does not suspend payment. Payments first cover accrued interest/costs, then the oldest unpaid invoice.
- Credit Assessment: We may check your creditworthiness. If justified, we can refuse an order or apply special terms. We can also request a deposit or other security before delivery; refusal is a breach.
- Invoice Complaints: Written objections must be lodged within 30 days of the invoice date. Otherwise, we assume acceptance. If you have paid, we consider you to have agreed with its contents.
- Collection Costs: If you are in default, you will be responsible for any applicable late fees, interest, and collection costs as permitted under the US Fair Debt Collection Practices Act (FDCPA). We reserve the right to recover reasonable legal fees in the event of a dispute.
Article 8: Changes in Products or Circumstances
- Minor Modifications: We may make minor improvements required by law or beneficial to product quality, provided they do not alter essential features.
- Significant Changes: If unexpected factors emerge—unknown at the Agreement’s inception—either party may request modifications for fairness. Additional costs due to your actions are billed to you.
- Address Updates: You must inform us of address changes in writing immediately. Deliveries to your last known address are deemed delivered.
Article 9: Cancellation, Return Shipment, and Right of Withdrawal
- Cancellation Costs: Canceling (in whole or part) before delivery obligates you to reimburse our reasonable costs and any direct or indirect damages. Personalized/custom orders cannot be canceled once production starts, unless we agree in writing.
- Last-Minute Cancellation: If you cancel within two weeks of the agreed delivery date, you owe the full invoice amount.
- Return Requirements: Returns need our written consent and are generally refused if Products are damaged, used, or not in original packaging, or if more than 30 days have passed. Special-condition or custom items are also excluded.
- Your Confirmation: You must confirm no prohibitions apply when requesting a return. We decide if the Products qualify for credit, exchange, or rejection based on their condition upon arrival.
- US Consumer Returns & Right of Withdrawal: If you are purchasing from the United States, our refund and return policies comply with applicable federal and state laws. Consumers in states that mandate return policies (e.g., California) may be entitled to additional rights.
If applicable state or federal laws provide greater return rights than those stated here, those laws take precedence. Unless legally required otherwise, returns must comply with the conditions outlined in these Terms.
- Shipping Costs: Additional shipping or handling fees may apply if the Product is returned from outside our usual service areas.
Article 10: Suspension and Termination
- Immediate Grounds: We may suspend or terminate the Agreement if:
- You breach essential terms and fail to fix the issue within 7 days of notice.
- You face bankruptcy, liquidation, or substantially cease business.
- Your finances deteriorate significantly, risking non-payment.
- You fail to provide required security or breach payment terms.
- Consequences: We can claim damages and demand immediate payment of all outstanding invoices plus interest. Termination does not affect accrued rights predating termination.
Article 11: Retention of Title
- Ownership: We retain ownership of all delivered Products until you settle all obligations under any Agreement with us. Title passes only after all payments are completed.
- Right to Repossess: If you fail to meet obligations or if we suspect non-compliance, we may reclaim the Products still under retention of title. You must fully cooperate.
- Third-Party Claims: You must inform us promptly if a third party attempts to seize or claim rights over our retained Products.
- Insurance and Protection: We may require you to insure the Products, assign any insurance claims to us, label them as our property, and assist in protecting our ownership rights.
Article 12: Conformity, Inspection, and Complaints
- Basic Quality: We ensure Products meet usual requirements for normal use at delivery. Natural materials (like wood) may shift or crack, which is not considered a defect.
- Inspection on Receipt: Upon delivery, verify that the Products match the Agreement in type, quantity, and condition, and note any visible damage.
- Visible vs. Non-Visible Defects: Report visible defects in writing within 14 days of delivery; non-visible defects within 14 days of discovery (but not beyond 3 months). Late reporting may forfeit your rights.
- Minor Variations: Small color or size variations do not justify a complaint. If a complaint is valid, we may offer a refund, price reduction, repair, or replacement.
- Obligations During Complaints: Even with a timely complaint, you must still pay and accept the Products unless we agree otherwise. Returns are only possible with prior written approval.
Article 13: Prices and Price Increases
- Sales Tax: Quoted prices generally exclude sales tax unless clearly stated otherwise.
- Price Adjustment: Within 3 months of the Agreement, we may raise prices only if required by law. You may cancel within 14 days if that occurs. After 3 months, we can adjust prices for market or cost reasons.
Article 14: Liability and Indemnification
- Scope of Liability: We are liable only for direct damages caused by our gross negligence or willful misconduct, subject to the limits in this article.
- No Indirect Damages: We are not liable for indirect or consequential damages (e.g., lost profits, business disruption). For Consumers, these limitations apply as far as Dutch law permits (Article 7:24(2) BW).
- Indemnification by You: You indemnify us against third-party claims not directly caused by us. We are not responsible for any damage that occurs under your control or someone else’s.
- Liability Cap: Our liability is capped by our insurer’s payout. If the insurer does not pay, it is limited to the invoice value of the relevant Product.
- Exemptions: We are not liable for force majeure events (Article 15), nor for damages arising from usage at festivals or similarly uncontrolled environments.
- US Consumer Protections & Liability Limitations: If you are a Consumer in the United States, certain limitations of liability in this Agreement may not apply in states where such disclaimers are restricted (including but not limited to California, New York, Texas, and Florida).
Subject to applicable federal and state law, our Products are provided “As-Is” and “With All Faults” unless otherwise required by law. Certain states, including California, New York, and Texas, may prohibit disclaimers on implied warranties or product fitness for a particular purpose.
Magnuson-Moss Warranty Act Notice: If you purchase a warranted Product in the United States, your warranty rights are governed by the Magnuson-Moss Warranty Act, which may entitle you to specific legal rights in addition to the warranty terms stated here.
Article 15: Force Majeure
- Definition: Force majeure includes unforeseen events beyond our control—strikes, raw material shortages, natural disasters, government actions, etc.—that make performance impossible or unreasonably burdensome.
- Post-Obligation Invocation: If these conditions arise after we should have delivered, we can still invoke force majeure. We may suspend or cancel obligations without liability for damages.
- Partial Performance: If we partially fulfilled obligations before force majeure, we may invoice for that portion. Force majeure affecting our suppliers also counts as force majeure for us.
Article 16: Intellectual and Industrial Property
- No Removal of Notices: You may not remove or alter any trademarks, copyrights, or other proprietary labels from our Products or materials.
- Prohibition on Imitation: Imitating or reproducing our products/designs is banned, as is providing them to third parties who might replicate them.
- Penalties: Breaching these prohibitions incurs a fine of 5% of the Product’s purchase price (min. $500 per item). You must enforce this through a chain clause on your successors.
Article 17: Health & Safety Disclaimers
- No Medical Advice: We do not offer medical advice. If you have heart conditions, are pregnant, take medication, or have health concerns, consult a professional before using an Icetub or IceSauna.
- Age Restrictions: Our Products are not recommended for minors without direct adult supervision. An adult should be aware of potential risks before allowing a minor to use the Product.
- Setup & Maintenance: You must ensure installation complies with local electrical/building codes. If unsure, hire qualified professionals to avoid safety hazards.
- Heat/Cold Sensitivities: Prolonged or extreme temperature exposure can be dangerous. Stop using the Product if you feel dizzy, faint, or unwell, and seek medical help if needed.
- US Consumer Product Safety Notice: Our Products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.
Claims regarding health benefits of the Icetub or IceSauna are based on general wellness and fitness principles, not on FDA-approved studies.
If you have pre-existing health conditions, consult a physician before use.
FTC Advertising Disclosure: We comply with US Federal Trade Commission (FTC) guidelines regarding advertising claims. Any statements about health benefits are intended for general informational purposes only.
Article 18: Personal Injury Waiver / Assumption of Risk
- Inherent Risks: By using our Icetub or IceSauna, you acknowledge there are inherent risks, including—but not limited to—slipping, falling, heat/cold stress, fainting, or shock. You voluntarily assume these risks.
- Immediate Cessation of Use: If you experience any adverse symptoms (e.g., shortness of breath, dizziness), stop use immediately and seek medical advice.
- Minor Supervision: If minors are allowed to use the Product (e.g., in a family setting), direct supervision by a responsible adult is mandatory.
- Disclaimer of Liability: Subject to applicable law, we are not liable for personal injuries resulting from your improper, unsafe, or negligent use of the Product. This includes failure to follow recommended instructions and guidelines.
Article 19: Privacy
- Data Processing: We process personal data (for orders, deliveries, etc.) in accordance with the GDPR and our Privacy Statement at icetubs.com/privacy-statement.
- Policy Updates: We may update our Privacy Statement; changes take effect upon communication. We encourage you to review it periodically.
Article 20: Final Provisions
- Amendments: We can amend these Conditions at any time. Changes take effect on the date communicated or upon notification if no date is specified. If you are a Consumer and a significant amendment harms your rights, you may dissolve the Agreement under Article 6:237(c) BW.
- Exclusion of Certain Articles: Articles 7:404, 7:407(2), and 7:409 of the Dutch Civil Code do not apply.
- Legal Claims: All legal claims expire 1 year after they arise. Only Dutch law applies. The Vienna Sales Convention is excluded.
- Dispute Resolution: Consumers in the United States may bring legal proceedings in either Dutch courts or the courts of their state of residence, subject to mandatory local legal protections.
- Version Control: The latest version or the version valid at the time the legal relationship started applies.
- Legal Jurisdiction: These Terms are governed by Dutch law, except where US federal or state laws provide mandatory consumer protections. In the event of a conflict between these Terms and applicable US consumer laws, the latter shall take precedence.
