By placing an order or using our services, you agree to these terms, ensuring a smooth and reliable experience for everyone. Please read them carefully.

Artículo 1: Definiciones
- “Nosotros” / “Nos”: Icetubs B.V., con domicilio en Nieuwpoortkade 16 (1055 XG Ámsterdam), registrada bajo el n.º 87358891, NIF: NL864273952B01, como vendedor.
- Icetub: Bañera de alta calidad diseñada tanto para agua helada como caliente, destinada exclusivamente a agua natural sin productos químicos añadidos, excepto aditivos aprobados por Icetubs.
- IceSauna: Sauna de hielo de alta calidad destinada exclusivamente a la terapia de calor y la relajación.
- Productos: Cualquier Icetub, IceSauna o accesorio relacionado vendido por nosotros.
- Usted: Cualquier parte (persona física o empresa) que celebre un Acuerdo con nosotros o reciba una oferta bajo estas Condiciones.
- Consumidor: Persona física que adquiere un Producto para uso personal y no comercial. Si usted es Consumidor, estas Condiciones se aplican salvo que la ley disponga otra cosa.
- Uso Profesional y/o Comercial: Cualquier compra que no sea estrictamente para un hogar privado individual, sino para un entorno comercial o profesional (p. ej., gimnasios, centros de bienestar).
- Acuerdo: El contrato entre usted y nosotros bajo estas Condiciones, formado según los pasos del Artículo 3.
- Condiciones: Estos términos y condiciones generales, que podemos actualizar según el Artículo 20.
- Derecho de Desistimiento: Un período de reflexión de 14 días para los Consumidores (pero no para los no consumidores) para cancelar un contrato a distancia sin penalización.
Artículo 2: Aplicabilidad de estas Condiciones
- Ámbito de Aplicación: Estas Condiciones rigen todas las ofertas, presupuestos y Acuerdos —tanto a través de nuestra tienda online como de cualquier otro medio— entre nosotros como vendedor/proveedor y usted como comprador, salvo modificación expresa por escrito.
- Rechazo de Otros Términos: Rechazamos expresamente cualquier otro término y condición general. Una desviación puntual no renuncia a nuestro derecho de adhesión estricta futura.
- Disposiciones Inválidas: Si alguna disposición es inválida o nula, el resto permanece vigente. Sustituiremos la parte nula por otra que se ajuste estrechamente a su propósito original.
- Incertidumbres / Lagunas: Cualquier incertidumbre o cuestión no contemplada deberá resolverse de manera coherente con estas Condiciones.
Artículo 3: Oferta y Formación del Acuerdo
- Ofertas No Vinculantes: Nuestras ofertas son no vinculantes salvo que se indique expresamente lo contrario por escrito. Una oferta puede caducar si el producto deja de estar disponible antes de su aceptación. No estamos vinculados por errores evidentes (p. ej., en los precios).
- Detalles de la Oferta: Cada oferta proporciona información suficiente para que comprenda sus derechos y obligaciones al aceptarla. Las imágenes o muestras son aproximadas y no son vinculantes contractualmente.
- Formación del Acuerdo: Un Acuerdo se forma cuando:
- Confirmamos su pedido por escrito, o
- Comenzamos a ejecutar el pedido de manera coherente con la aceptación (p. ej., preparando el envío).
- Aceptación Divergente: Si su aceptación difiere de nuestra oferta, no estamos vinculados salvo que lo confirmemos por escrito. Los presupuestos o tarifas anteriores no se aplican automáticamente a nuevos Acuerdos.
- Contratos a Distancia con Consumidores: Si usted es Consumidor, el Acuerdo se forma una vez que acepta y cumple las condiciones establecidas. Si se acepta electrónicamente, confirmaremos la recepción sin demora; de lo contrario, podrá disolver el Acuerdo.
- Medidas de Seguridad: Implementamos medidas técnicas y organizativas para transacciones electrónicas seguras. Si usted es Consumidor, le proporcionaremos detalles esenciales (p. ej., dirección, información sobre el Derecho de Desistimiento) en un soporte duradero antes o en el momento de la entrega.
Artículo 4: Entrega
- Principio Ex Works: Salvo acuerdo escrito en contrario, los Productos se entregan en fábrica (nuestro almacén). Usted asume el riesgo/los costes una vez que los Productos salen de nuestras instalaciones.
- Aceptación y Transferencia de Riesgo: Debe aceptar la entrega cuando se le ofrezca. El riesgo de pérdida, daños o depreciación se transfiere a usted en cuanto los Productos se entreguen a usted, su agente o el transportista que haya elegido.
- Accesibilidad del Lugar: Usted es responsable de garantizar que el lugar de entrega sea accesible y de obtener los permisos necesarios. El equipo especializado (p. ej., una grúa) corre a su cargo salvo acuerdo en contrario.
- Suministro de Información: Solo comenzamos tras recibir los datos necesarios de su parte. La no aceptación de la entrega o la falta de instrucciones puede dar lugar a almacenamiento a su riesgo y coste.
- Terceros: Podemos utilizar mensajeros o existencias de terceros para cumplir los pedidos. Si se incumple una fecha de entrega, debe notificarnóslo por escrito y conceder un período razonable para la entrega.
- Responsabilidad por Retraso: No somos responsables de los retrasos debidos a fuerza mayor o instrucciones incompletas de su parte. Si no entregamos (fuera de la fuerza mayor) y somos responsables, nuestra responsabilidad se limita a la diferencia de precio si debe comprar un producto comparable en otro lugar.
- Entregas Parciales: Podemos entregar por plazos, facturando cada uno por separado. En Acuerdos por fases, podemos pausar fases posteriores hasta que usted apruebe los resultados anteriores.
- Entregas Pospuestas o Divididas: Si difiere o divide las entregas o no recoge los Productos, el riesgo se transfiere una vez que los etiquetamos como suyos en nuestros registros.
Artículo 5: Uso Correcto del Icetub y la IceSauna
Esta sección describe las pautas esenciales para el uso seguro y correcto del Icetub (baño de hielo) y la IceSauna. El incumplimiento de estas instrucciones puede provocar lesiones, daños al equipo o la pérdida de reclamaciones de responsabilidad.
I. Pautas Generales de Seguridad (Aplicables a Icetub e IceSauna)
- Instrucciones del Fabricante & Normativa Local
- Siga siempre las pautas oficiales de instalación, funcionamiento y mantenimiento.
- La instalación debe cumplir con las normativas eléctricas y de seguridad locales. En caso de duda, contrate a un profesional cualificado.
- Conducta del Usuario & Advertencias de Salud
- Sin Alcohol ni Drogas: No utilice ninguno de los dos productos bajo la influencia de alcohol, drogas o medicamentos que puedan deteriorar el juicio.
- Asesoramiento Médico: Las personas con enfermedades cardíacas, presión arterial alta, problemas respiratorios, trastornos circulatorios u otras preocupaciones de salud deben consultar a un médico antes de usarlos.
- Supervisión de Menores: Los niños menores de 16 años solo pueden usar el Icetub o la IceSauna bajo supervisión directa de un adulto.
- Cese Inmediato del Uso: Deje de usar inmediatamente y busque atención médica si experimenta mareos, dificultad para respirar, entumecimiento o malestar.
- Seguridad Eléctrica e Instalación
- Utilice siempre una fuente de alimentación correctamente conectada a tierra y protegida de la exposición al agua.
- Uso Correcto de Cables de Extensión: Utilice solo cables de extensión correctamente conectados a tierra y con la capacidad adecuada para los requisitos de potencia del Icetub.
- Inspecciones Regulares: Compruebe con frecuencia los cables de alimentación, enchufes y componentes eléctricos para detectar daños o desgaste.
- Ubicación del Cuadro Eléctrico: El cuadro eléctrico no debe descansar directamente en el suelo. Debe protegerse de la exposición excesiva al agua e idealmente montarse en la pared por debajo del enchufe de alimentación.
- Ubicación y Consideraciones Ambientales
- Superficie Estable: Coloque en una superficie nivelada y antideslizante para evitar vuelcos o caídas.
- Ventilación: Si se usa en interiores, garantice un flujo de aire adecuado para evitar el sobrecalentamiento, la condensación o el agotamiento del oxígeno.
- Peligros de Incendio y Humo: No utilice llamas abiertas, velas o materiales inflamables dentro o cerca de ninguno de los dos productos.
II. Pautas Específicas del Icetub
- Restricciones de Uso en Exterior
- Precaución bajo -5°C: No opere el Icetub en exterior por debajo de -5°C. Desconecte la unidad de enfriamiento y guárdela en interior.
- Entre -5°C y 1°C: Opere el motor de enfriamiento en modo “automático” 24/7, con todos los temporizadores apagados, para evitar la congelación.
- Clima Extremo: Evite el uso durante tormentas eléctricas, rayos o condiciones meteorológicas extremas.
- Uso en Solitario: Nunca use el Icetub en exterior solo. Asegúrese de que alguien esté al tanto de su sesión.
- Calidad del Agua & Mantenimiento
- Solo Aditivos Aprobados: Use únicamente el tratamiento de agua AquaFinesse de Icetubs para el mantenimiento estándar. Evite bromo, sales u otros químicos no autorizados.
- Cambios de Agua Regulares: Cambie el agua y los filtros regularmente según el uso.
- Pruebas de Agua (Para Clientes Profesionales): Los entornos de uso intensivo deben realizar pruebas periódicas de calidad del agua.
- Restricciones de Uso en Interior
- Sin Uso Desatendido: Nunca use el Icetub solo en interior.
III. Pautas Específicas de la IceSauna
- Límites de Temperatura y Exposición
- Límites de Tiempo: La duración recomendada de la sesión es de 15-30 minutos con descansos intermedios.
- Hidratación: Mantenga una hidratación adecuada antes y después del uso.
- Conciencia del Usuario: Si se siente mareado, mal o con calor excesivo, salga inmediatamente y refrésquese.
- Ubicación y Seguridad de Uso
- Clima Extremo: Evite usar la IceSauna durante tormentas eléctricas, rayos o vientos fuertes.
- Ventilación Interior: Garantice un flujo de aire adecuado para evitar la acumulación de calor o el agotamiento de oxígeno.
- Ropa Adecuada: Use ropa transpirable y apropiada para sauna; evite tejidos pesados o sintéticos.
- Sin Uso Desatendido: Nunca use la IceSauna solo.
IV. Asunción de Riesgo & Descargo de Responsabilidad
- Aceptación Voluntaria del Riesgo
- Al usar el Icetub o la IceSauna, reconoce y acepta los riesgos inherentes asociados con la exposición a temperaturas, equipos eléctricos y seguridad en el agua.
- Sin Responsabilidad por Uso Incorrecto
- Icetubs B.V. no es responsable de lesiones, daños o complicaciones de salud resultantes del uso incorrecto, el incumplimiento de las instrucciones o el comportamiento inseguro.
- Consecuencias del Uso Incorrecto del Producto
- Cualquier daño causado por modificaciones no autorizadas, uso incorrecto de productos químicos o negligencia anulará cualquier reclamación de defecto del producto.
Artículo 6: Muestras, Modelos y Datos
- Solo Indicativos: Los modelos, muestras o planos que proporcionamos son aproximaciones; los Productos reales pueden diferir ligeramente.
- Modificaciones de Datos: Podemos actualizar o modificar catálogos, especificaciones técnicas o datos sin previo aviso; dichos materiales no son vinculantes salvo confirmación por escrito.
- Cantidades Mínimas: Nos reservamos el derecho a establecer cantidades mínimas de pedido para determinados Productos.
- Propiedad de los Materiales: Los modelos o muestras que suministramos siguen siendo nuestros salvo acuerdo escrito en contrario.
Artículo 7: Pago; Intereses y Costas de Cobro
- Plazo de Pago: Salvo indicación contraria, las facturas son pagaderas en un plazo de 30 días desde la fecha de la factura, sin descuento ni compensación, en nuestro banco (NL86 RABO 0319 5907 12, Icetubs B.V.).
- Mora: El impago a tiempo le coloca automáticamente en mora. Los intereses legales se acumulan desde la fecha de vencimiento. En caso de liquidación, quiebra o reestructuración de deuda, todos los importes se vuelven inmediatamente exigibles.
- Disputas de Facturas: Disputar una factura no suspende el pago.
- Evaluación de Crédito: Podemos verificar su solvencia y, si está justificado, rechazar un pedido o aplicar condiciones especiales.
- Reclamaciones de Facturas: Las objeciones escritas deben presentarse en un plazo de 30 días desde la fecha de la factura.
- Costas de Cobro: Si está en mora, deberá intereses legales más costas de cobro extrajudiciales. Cualquier coste mayor necesario (incluidos honorarios legales) también corre a su cargo.
Artículo 8: Cambios en los Productos o las Circunstancias
- Modificaciones Menores: Podemos realizar mejoras menores exigidas por la ley o beneficiosas para la calidad del producto, siempre que no alteren las características esenciales.
- Cambios Significativos: Si surgen factores imprevistos, cualquiera de las partes puede solicitar modificaciones por equidad. Los costes adicionales debidos a sus acciones se le facturarán.
- Actualizaciones de Dirección: Debe informarnos de los cambios de dirección por escrito de inmediato.
Artículo 9: Cancelación, Devolución y Derecho de Desistimiento
- Costes de Cancelación: La cancelación (total o parcial) antes de la entrega le obliga a reembolsar nuestros costes razonables y cualquier daño directo o indirecto. Los pedidos personalizados no pueden cancelarse una vez iniciada la producción.
- Cancelación de Última Hora: Si cancela dentro de las dos semanas anteriores a la fecha de entrega acordada, adeuda el importe total de la factura.
- Requisitos de Devolución: Las devoluciones requieren nuestro consentimiento por escrito y generalmente se rechazan si los Productos están dañados, usados o no están en su embalaje original, o si han pasado más de 30 días.
- Su Confirmación: Debe confirmar que no se aplica ningún tipo de prohibición al solicitar una devolución.
- Derecho de Desistimiento del Consumidor: Los Consumidores tienen 14 días desde la recepción para desistir de un contrato a distancia sin causa. Si se realizó el pago, realizaremos el reembolso en un plazo de 14 días tras recibir los Productos o el comprobante de devolución.
- Gastos de Envío: Pueden aplicarse gastos adicionales de envío o manipulación si el Producto se devuelve desde fuera de nuestras áreas de servicio habituales.
Artículo 10: Suspensión y Rescisión
- Causas Inmediatas: Podemos suspender o rescindir el Acuerdo si:
- Incumple términos esenciales y no soluciona el problema en un plazo de 7 días desde la notificación.
- Se declara en quiebra, liquidación o cesa sustancialmente su actividad empresarial.
- Su situación financiera se deteriora significativamente, arriesgando el impago.
- No proporciona la garantía requerida o incumple los términos de pago.
- Consecuencias: Podemos reclamar daños y exigir el pago inmediato de todas las facturas pendientes más intereses.
Artículo 11: Reserva de Dominio
- Propiedad: Conservamos la propiedad de todos los Productos entregados hasta que usted liquide todas las obligaciones bajo cualquier Acuerdo con nosotros.
- Derecho de Recuperación: Si no cumple sus obligaciones, podemos recuperar los Productos sujetos a reserva de dominio. Debe cooperar plenamente.
- Reclamaciones de Terceros: Debe informarnos de inmediato si un tercero intenta embargar o reclamar derechos sobre nuestros Productos retenidos.
- Seguro y Protección: Podemos exigirle que asegure los Productos, nos ceda cualquier reclamación de seguro y nos ayude a proteger nuestros derechos de propiedad.
Artículo 12: Conformidad, Inspección y Reclamaciones
- Calidad Básica: Garantizamos que los Productos cumplen los requisitos habituales para el uso normal en el momento de la entrega.
- Inspección al Recibir: Al recibirlos, verifique que los Productos coincidan con el Acuerdo en tipo, cantidad y condición, y anote cualquier daño visible.
- Defectos Visibles vs. No Visibles: Notifique los defectos visibles por escrito en un plazo de 14 días desde la entrega; los no visibles en un plazo de 14 días desde su descubrimiento (pero no más allá de 3 meses).
- Variaciones Menores: Las pequeñas variaciones de color o tamaño no justifican una reclamación.
- Obligaciones Durante las Reclamaciones: Incluso con una reclamación oportuna, debe pagar y aceptar los Productos salvo que acordemos lo contrario.
Artículo 13: Precios e Incrementos de Precios
- IVA: Los precios cotizados generalmente excluyen el 21% de IVA salvo indicación contraria clara.
- Ajuste de Precios: En los primeros 3 meses del Acuerdo, solo podemos subir los precios si la ley lo requiere. Puede cancelar en un plazo de 14 días si eso ocurre. Pasados los 3 meses, podemos ajustar los precios por razones de mercado o coste.
Artículo 14: Responsabilidad e Indemnización
- Ámbito de Responsabilidad: Solo somos responsables de los daños directos causados por nuestra negligencia grave o mala conducta intencional.
- Sin Daños Indirectos: No somos responsables de daños indirectos o consecuentes (p. ej., lucro cesante, interrupción de negocio).
- Indemnización por su Parte: Nos indemnizan frente a reclamaciones de terceros no causadas directamente por nosotros.
- Límite de Responsabilidad: Nuestra responsabilidad está limitada al pago de nuestro asegurador.
- Exenciones: No somos responsables de los eventos de fuerza mayor (Artículo 15) ni de daños derivados del uso en festivales o entornos igualmente no controlados.
Artículo 15: Fuerza Mayor
- Definición: La fuerza mayor incluye eventos imprevistos fuera de nuestro control —huelgas, escasez de materias primas, desastres naturales, acciones gubernamentales, etc.— que hacen que el cumplimiento sea imposible o irrazonablemente gravoso.
- Invocación Post-Obligación: Podemos invocar la fuerza mayor incluso después del momento en que debíamos haber entregado. Podemos suspender o cancelar obligaciones sin responsabilidad por daños.
- Cumplimiento Parcial: Si cumplimos parcialmente las obligaciones antes de la fuerza mayor, podemos facturar esa parte.
Artículo 16: Propiedad Intelectual e Industrial
- Sin Eliminación de Avisos: No puede eliminar ni modificar marcas comerciales, derechos de autor u otras etiquetas de propiedad de nuestros Productos o materiales.
- Prohibición de Imitación: Imitar o reproducir nuestros productos/diseños está prohibido.
- Sanciones: El incumplimiento de estas prohibiciones conlleva una multa del 5% del precio de compra del Producto (mín. 500 € por artículo).
Artículo 17: Avisos Legales de Salud y Seguridad
- Sin Asesoramiento Médico: No ofrecemos asesoramiento médico. Si tiene enfermedades cardíacas, está embarazada, toma medicamentos o tiene preocupaciones de salud, consulte a un profesional antes de usar un Icetub o IceSauna.
- Restricciones de Edad: Nuestros Productos no se recomiendan para menores sin supervisión directa de un adulto.
- Instalación y Mantenimiento: Debe asegurarse de que la instalación cumple con los códigos eléctricos/de construcción locales.
- Sensibilidades al Calor/Frío: La exposición prolongada o extrema a temperaturas puede ser peligrosa. Deje de usar el Producto si se siente mareado, desmayado o indispuesto.
Artículo 18: Exención de Responsabilidad por Lesiones Personales / Asunción de Riesgo
- Riesgos Inherentes: Al usar nuestro Icetub o IceSauna, reconoce que existen riesgos inherentes, incluyendo —pero no limitados a— resbalones, caídas, estrés por calor/frío, desmayo o shock. Asume voluntariamente estos riesgos.
- Cese Inmediato del Uso: Si experimenta síntomas adversos (p. ej., dificultad para respirar, mareos), deje de usar de inmediato y busque asesoramiento médico.
- Supervisión de Menores: Si se permite a menores usar el Producto, la supervisión directa de un adulto responsable es obligatoria.
- Descargo de Responsabilidad: Sujeto al derecho aplicable, no somos responsables de lesiones personales resultantes de su uso incorrecto, inseguro o negligente del Producto.
Artículo 19: Privacidad
- Tratamiento de Datos: Tratamos los datos personales (para pedidos, entregas, etc.) de conformidad con el RGPD y nuestra Política de Privacidad en icetubs.com/privacy-statement.
- Actualizaciones de Política: Podemos actualizar nuestra Política de Privacidad; los cambios entrarán en vigor al comunicarse.
Artículo 20: Disposiciones Finales
- Enmiendas: Podemos modificar estas Condiciones en cualquier momento. Los cambios entrarán en vigor en la fecha comunicada.
- Exclusión de Determinados Artículos: Los artículos 7:404, 7:407(2) y 7:409 del Código Civil neerlandesa no se aplican.
- Reclamaciones Legales: Todas las reclamaciones legales prescriben 1 año después de su surgimiento. Solo se aplica el derecho neerlandes.
- Resolución de Disputas: Las disputas se someten al tribunal competente de Ámsterdam, Países Bajos.
- Control de Versiones: Se aplica la última versión o la versión válida en el momento en que se inició la relación jurídica.

Article 1: Definitions
- “We” / “Us”: Icetubs B.V., located at Nieuwpoortkade 16, (1055 XG Amsterdam), registered under no. 87358891, VAT no. NL864273952B01, acting as the seller.
- Icetub: A high-quality tub designed for both ice-cold and hot water use, intended exclusively for natural water with no added chemicals, except for additives approved by Icetubs
- IceSauna: A high-quality ice sauna intended exclusively for heat therapy and relaxation.
- Products: Any Icetubs, IceSaunas, or related accessories sold by us.
- You: Any party (individual or business) entering into an Agreement with us or receiving an offer from us under these Conditions.
- Consumer: A natural person purchasing a Product for personal, non-commercial use. If you are a Consumer, these Conditions apply unless otherwise specified by law (e.g., Consumer Rights Act 2015).
- Professional and/or Business Use: Any purchase not strictly for a single private household, but for a commercial or professional setting (e.g., gyms, wellness centers).
- Agreement: The contract between you and us under these Conditions, formed according to the steps in Article 3.
- Conditions: These general terms and conditions, which we may update under Article 20.
- Right of Withdrawal: A 14-day cooling-off period for Consumers (but not for non-consumers) to cancel a distance contract without penalty.
Article 2: Applicability of These Conditions
- Scope: These Conditions govern all offers, quotations, and Agreements—whether via our webshop or otherwise—between us as seller/supplier and you as purchaser, unless explicitly modified in writing.
- Rejection of Other Terms: We expressly reject any other general terms and conditions. These Conditions also apply to all Agreements involving third parties. Deviating once does not waive our right to future strict adherence.
- Invalid Provisions: If any provision is invalid or void, the remaining provisions remain in effect. We will replace the null or voided part with one closely matching its original purpose.
- Uncertainties / Gaps: Any uncertainties or unaddressed issues must be resolved in a way consistent with these Conditions.
- Consumer Rights Act 2015: If you are a Consumer in the United Kingdom, your statutory rights under the Consumer Rights Act 2015 will apply where applicable. If any clause in these Terms contradicts your statutory rights, the Consumer Rights Act 2015 will take precedence
Article 3: Offer and Formation of Agreement
- Non-Binding Offers: Our offers are non-binding unless explicitly stated otherwise in writing. An offer may expire if the product becomes unavailable before acceptance. We are not bound by obvious errors (e.g., in pricing).
- Offer Details: Each offer provides enough information for you to understand your rights and obligations on acceptance. Images or samples are approximate and not contractually binding.
- Agreement Formation: An Agreement is formed when:
- We confirm your order in writing, or
- We begin fulfilling the order in a manner consistent with acceptance (e.g., preparing shipment).
- Deviating Acceptance: If your acceptance differs from our offer, we are not bound unless we confirm in writing. Past quotations or rates do not automatically apply to new Agreements.
- Distance Contracts with Consumers: If you are a Consumer, the Agreement forms once you accept and meet any stated conditions. If accepted electronically, we will confirm receipt without delay; otherwise, you may dissolve the Agreement.
- Security Measures: We implement technical and organizational measures for secure electronic transactions. If you are a Consumer, we will provide essential details (e.g., address, Right of Withdrawal info) on a durable medium by or before delivery.
Article 4: Delivery
- Ex Works Principle: Unless agreed otherwise in writing, Products are delivered ex works (our warehouse). You assume risk/costs once Products leave our facility.
- Acceptance and Risk Transfer: You must accept delivery when offered. Risk of loss, damage, or depreciation transfers to you as soon as the Products are handed over to you, your agent, or your chosen carrier.

- UK Import Responsibilities: If you are purchasing from the United Kingdom, you are responsible for paying any applicable import duties, customs tariffs, or local taxes upon arrival. It is your responsibility to ensure compliance with UK product regulations unless we explicitly confirm conformity in writing.

I. General Safety Guidelines (Applies to Both Icetub & IceSauna)
- Manufacturer Instructions & Local Compliance
- Always follow official setup, operation, and maintenance guidelines.
- Installation must comply with local electrical and safety regulations. If uncertain, hire a qualified professional.
- User Conduct & Health Warnings
- No Alcohol or Drug Use: Do not use either product while under the influence of alcohol, drugs, or medications that may impair judgment.
- Medical Advisory: Individuals with heart conditions, high blood pressure, respiratory issues, circulatory disorders, or other health concerns should consult a physician before use.
- Minor Supervision: Children under 16 years must only use the Icetub or IceSauna under direct adult supervision.
- Immediate Cessation of Use: Stop use immediately and seek medical attention if you experience dizziness, shortness of breath, numbness, or discomfort.
- Electrical & Installation Safety
- Always use a properly grounded power source protected from water exposure.
- Proper Extension Cord Use: Only use extension cords that are properly grounded and rated for the Icetub’s power requirements. Avoid ungrounded or low-capacity cords, as they may cause overheating or fire hazards. Plug directly into a dedicated power outlet whenever possible.
- Regular Inspections: Frequently check power cords, plugs, and electrical components for damage or wear.
- Fusebox Placement: The fusebox must not rest directly on the ground. It should be protected from excessive water exposure and ideally mounted along the wall below the power plug.
- Water Resistance Limitation: While the fusebox is water-resistant, it is not designed to withstand prolonged submersion or being placed in standing water (e.g., puddles). Ensure proper installation to prevent damage.
- Placement & Environmental Considerations
- Stable Surface: Place on a level, non-slippery surface to prevent tipping or falls.
- Ventilation: If used indoors, ensure proper airflow to prevent overheating, condensation, or oxygen depletion.
- Fire & Smoke Hazards: Do not use open flames, candles, or flammable materials inside or near either product.
II. Icetub-Specific Guidelines
- Outdoor Use Restrictions
- Under -5°C precaution: Do not operate the Icetub outdoors below -5°C. Detach the cooling unit and store it indoors to prevent damage.
- Between -5°C and 1°C: Operate the cooling engine on “automatic” mode 24/7, with all timers off, to prevent freezing.
- Severe Weather: Avoid use during thunderstorms, lightning, or extreme weather.
- Solo Use: Never use the Icetub outdoors alone. Ensure someone is aware of your session.
- Water Quality & Maintenance
- Approved Additives Only: Use only Icetubs’ AquaFinesse water treatment for standard maintenance. Professional clients using the Hanna system provided by Icetubs may use chlorine as needed, following proper dilution and safety guidelines. Avoid bromine, salts, or other unauthorized chemicals, as they may corrode components.
- Regular Water Changes: Change the water and filters regularly based on usage to maintain hygiene and system longevity.
- Water Testing (For Professional Clients): High-use environments, such as gyms and wellness centers, should conduct periodic water quality testing to ensure compliance with local hygiene and safety standards.
- Indoor Use Restrictions
- No Unattended Use: Never use the Icetub alone indoors. Ensure someone is aware of your session.
III. IceSauna-Specific Guidelines
- Temperature & Exposure Limits
- Time Limits: Recommended session duration is 15–30 minutes with breaks in between.
- Hydration: Stay properly hydrated before and after use to avoid dehydration or heat exhaustion.
- User Awareness: If you feel lightheaded, unwell, or overheated, exit immediately and cool down.
- Placement & Usage Safety
- Extreme Weather: Avoid using the IceSauna during thunderstorms, lightning, or high winds.
- Indoor Ventilation: Ensure adequate airflow to prevent heat buildup or oxygen depletion.
- Appropriate Attire: Wear breathable, sauna-appropriate clothing; avoid heavy or synthetic fabrics.

IV. Assumption of Risk & Liability Disclaimer

Article 6: Samples, Models, and Data
- Indicative Only: Models, samples, or drawings we provide are approximations; actual Products may differ slightly, especially if made from natural materials.
- Data Modifications: We may update or alter catalogs, technical specs, or data without notice; such materials are not binding unless confirmed in writing.
- Minimum Quantities: We reserve the right to set minimum order quantities for certain Products.
- Ownership of Materials: Any models or samples we supply remain ours unless agreed otherwise in writing; those you supply remain yours.
Article 7: Payment; Interest and Collection Costs
- Payment Deadline: Unless stated otherwise, invoices are payable within 30 days of the invoice date, without discount or setoff, to our bank (NL86 RABO 0319 5907 12, Icetubs B.V.).
- Default: Failing to pay on time places you in default automatically. Statutory interest accrues from the due date. If you face liquidation, bankruptcy, or debt restructuring, all sums become immediately payable.
- Invoice Disputes: Disputing an invoice does not suspend payment. Payments first cover accrued interest/costs, then the oldest unpaid invoice.
- Credit Assessment: We may check your creditworthiness. If justified, we can refuse an order or apply special terms. We can also request a deposit or other security before delivery; refusal is a breach.
- Invoice Complaints: Written objections must be lodged within 30 days of the invoice date. Otherwise, we assume acceptance. If you have paid, we consider you to have agreed with its contents.
- Collection Costs: If you are in default, you owe statutory interest plus extrajudicial collection costs per the Dutch Order of Advocates. Any higher necessary costs (including legal fees) are also yours.
Article 8: Changes in Products or Circumstances
- Minor Modifications: We may make minor improvements required by law or beneficial to product quality, provided they do not alter essential features.
- Significant Changes: If unexpected factors emerge—unknown at the Agreement’s inception—either party may request modifications for fairness. Additional costs due to your actions are billed to you.
- Address Updates: You must inform us of address changes in writing immediately. Deliveries to your last known address are deemed delivered.
Article 9: Cancellation, Return Shipment, and Right of Withdrawal
- Cancellation Costs: Canceling (in whole or part) before delivery obligates you to reimburse our reasonable costs and any direct or indirect damages. Personalized/custom orders cannot be canceled once production starts, unless we agree in writing.
- Last-Minute Cancellation: If you cancel within two weeks of the agreed delivery date, you owe the full invoice amount.
- Return Requirements: Returns need our written consent and are generally refused if Products are damaged, used, or not in original packaging, or if more than 30 days have passed. Special-condition or custom items are also excluded.
- Your Confirmation: You must confirm no prohibitions apply when requesting a return. We decide if the Products qualify for credit, exchange, or rejection based on their condition upon arrival.
- Consumer Right of Withdrawal: Consumers in the United Kingdom have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel an order for most Products within 14 days of receiving them. This does not apply to custom-made or perishable goods
- Shipping Costs: Additional shipping or handling fees may apply if the Product is returned from outside our usual service areas.
- Additional UK Consumer Rights: If you are a Consumer in the United Kingdom, local legislation may grant you extra or different return/cancellation rights than those stated here. In case of conflict, those local rights prevail.
Article 10: Suspension and Termination
- Immediate Grounds: We may suspend or terminate the Agreement if:
- You breach essential terms and fail to fix the issue within 7 days of notice.
- You face bankruptcy, liquidation, or substantially cease business.
- Your finances deteriorate significantly, risking non-payment.
- You fail to provide required security or breach payment terms.
- Consequences: We can claim damages and demand immediate payment of all outstanding invoices plus interest. Termination does not affect accrued rights predating termination.
Article 11: Retention of Title
- Ownership: We retain ownership of all delivered Products until you settle all obligations under any Agreement with us. Title passes only after all payments are completed.
- Right to Repossess: If you fail to meet obligations or if we suspect non-compliance, we may reclaim the Products still under retention of title. You must fully cooperate.
- Third-Party Claims: You must inform us promptly if a third party attempts to seize or claim rights over our retained Products.
- Insurance and Protection: We may require you to insure the Products, assign any insurance claims to us, label them as our property, and assist in protecting our ownership rights.
Article 12: Conformity, Inspection, and Complaints
- Basic Quality: We ensure Products meet usual requirements for normal use at delivery. Natural materials (like wood) may shift or crack, which is not considered a defect.
- Inspection on Receipt: Upon delivery, verify that the Products match the Agreement in type, quantity, and condition, and note any visible damage.
- Visible vs. Non-Visible Defects: Report visible defects in writing within 14 days of delivery; non-visible defects within 14 days of discovery (but not beyond 3 months). Late reporting may forfeit your rights.
- Minor Variations: Small color or size variations do not justify a complaint. If a complaint is valid, we may offer a refund, price reduction, repair, or replacement.
- Obligations During Complaints: Even with a timely complaint, you must still pay and accept the Products unless we agree otherwise. Returns are only possible with prior written approval.
Article 13: Prices and Price Increases
- VAT: Quoted prices generally exclude 20% VAT unless clearly stated otherwise.
- Price Adjustment: Within 3 months of the Agreement, we may raise prices only if required by law. You may cancel within 14 days if that occurs. After 3 months, we can adjust prices for market or cost reasons.
Article 14: Liability and Indemnification
- Scope of Liability: We are liable only for direct damages caused by our gross negligence or willful misconduct, subject to the limits in this article.
- No Indirect Damages: We are not liable for indirect or consequential damages (e.g., lost profits, business disruption). For Consumers, these limitations apply as far as Dutch law permits (Article 7:24(2) BW).
- Indemnification by You: You indemnify us against third-party claims not directly caused by us. We are not responsible for any damage that occurs under your control or someone else’s.
- Liability Cap: Our liability is capped by our insurer’s payout. If the insurer does not pay, it is limited to the invoice value of the relevant Product.
- Exemptions: We are not liable for force majeure events (Article 15), nor for damages arising from usage at festivals or similarly uncontrolled environments.
- Mandatory Local Laws: UK law does not permit disclaimers or limitations of certain implied warranties or liabilities. If so, any conflicting limitations in these Conditions do not apply to the extent prohibited by local law.
Article 15: Force Majeure
- Definition: Force majeure includes unforeseen events beyond our control—strikes, raw material shortages, natural disasters, government actions, etc.—that make performance impossible or unreasonably burdensome.
- Post-Obligation Invocation: If these conditions arise after we should have delivered, we can still invoke force majeure. We may suspend or cancel obligations without liability for damages.
- Partial Performance: If we partially fulfilled obligations before force majeure, we may invoice for that portion. Force majeure affecting our suppliers also counts as force majeure for us.
Article 16: Intellectual and Industrial Property
- No Removal of Notices: You may not remove or alter any trademarks, copyrights, or other proprietary labels from our Products or materials.
- Prohibition on Imitation: Imitating or reproducing our products/designs is banned, as is providing them to third parties who might replicate them.
- Penalties: Breaching these prohibitions incurs a fine of 5% of the Product’s purchase price (min. £500 per item). You must enforce this through a chain clause on your successors.
Article 17: Health & Safety Disclaimers
- No Medical Advice: We do not offer medical advice. If you have heart conditions, are pregnant, take medication, or have health concerns, consult a professional before using an Icetub or IceSauna.
- Age Restrictions: Our Products are not recommended for minors without direct adult supervision. An adult should be aware of potential risks before allowing a minor to use the Product.
- Setup & Maintenance: You must ensure installation complies with local electrical/building codes. If unsure, hire qualified professionals to avoid safety hazards.
- Heat/Cold Sensitivities: Prolonged or extreme temperature exposure can be dangerous. Stop using the Product if you feel dizzy, faint, or unwell, and seek medical help if needed.
Article 18: Personal Injury Waiver / Assumption of Risk
- Inherent Risks: By using our Icetub or IceSauna, you acknowledge there are inherent risks, including—but not limited to—slipping, falling, heat/cold stress, fainting, or shock. You voluntarily assume these risks.
- Immediate Cessation of Use: If you experience any adverse symptoms (e.g., shortness of breath, dizziness), stop use immediately and seek medical advice.
- Minor Supervision: If minors are allowed to use the Product (e.g., in a family setting), direct supervision by a responsible adult is mandatory.
- Disclaimer of Liability: Subject to applicable law, we are not liable for personal injuries resulting from your improper, unsafe, or negligent use of the Product. This includes failure to follow recommended instructions and guidelines.
Article 19: Privacy
- Data Processing: We process personal data (for orders, deliveries, etc.) in accordance with the GDPR and our Privacy Statement at icetubs.com/privacy-statement.
- Policy Updates: We may update our Privacy Statement; changes take effect upon communication. We encourage you to review it periodically.
Article 20: Final Provisions
- Amendments: We can amend these Conditions at any time. Changes take effect on the date communicated or upon notification if no date is specified. If you are a Consumer and a significant amendment harms your rights, you may dissolve the Agreement under Article 6:237(c) BW.
- Exclusion of Certain Articles: Articles 7:404, 7:407(2), and 7:409 of the Dutch Civil Code do not apply.
- Legal Claims: All legal claims expire 1 year after they arise. Only Dutch law applies. The Vienna Sales Convention is excluded.
- Dispute Resolution: Disputes go to the competent court in Amsterdam, Netherlands, unless another court is mandated by law.
- Version Control: The latest version or the version valid at the time the legal relationship started applies.
- Legal Jurisdiction: These Terms are governed by Dutch law. However, if you are a Consumer in the United Kingdom, you may bring legal proceedings either in the Netherlands or in the UK courts where you reside, in accordance with UK consumer law.

- Indicative Only: Models, samples, or drawings we provide are approximations; actual Products may differ slightly, especially if made from natural materials.
- Data Modifications: We may update or alter catalogs, technical specs, or data without notice; such materials are not binding unless confirmed in writing.
- Minimum Quantities: We reserve the right to set minimum order quantities for certain Products.
- Ownership of Materials: Any models or samples we supply remain ours unless agreed otherwise in writing; those you supply remain yours.
Article 7: Payment; Interest and Collection Costs
- Payment Deadline: Unless stated otherwise, invoices are payable within 30 days of the invoice date, without discount or setoff, to our bank
- Default: Failing to pay on time places you in default automatically. Statutory interest accrues from the due date. If you face liquidation, bankruptcy, or debt restructuring, all sums become immediately payable.
- Invoice Disputes: Disputing an invoice does not suspend payment. Payments first cover accrued interest/costs, then the oldest unpaid invoice.
- Credit Assessment: We may check your creditworthiness. If justified, we can refuse an order or apply special terms. We can also request a deposit or other security before delivery; refusal is a breach.
- Invoice Complaints: Written objections must be lodged within 30 days of the invoice date. Otherwise, we assume acceptance. If you have paid, we consider you to have agreed with its contents.
- Collection Costs: If you are in default, you will be responsible for any applicable late fees, interest, and collection costs as permitted under the US Fair Debt Collection Practices Act (FDCPA). We reserve the right to recover reasonable legal fees in the event of a dispute.
Article 8: Changes in Products or Circumstances
- Minor Modifications: We may make minor improvements required by law or beneficial to product quality, provided they do not alter essential features.
- Significant Changes: If unexpected factors emerge—unknown at the Agreement’s inception—either party may request modifications for fairness. Additional costs due to your actions are billed to you.
- Address Updates: You must inform us of address changes in writing immediately. Deliveries to your last known address are deemed delivered.
Article 9: Cancellation, Return Shipment, and Right of Withdrawal
- Cancellation Costs: Canceling (in whole or part) before delivery obligates you to reimburse our reasonable costs and any direct or indirect damages. Personalized/custom orders cannot be canceled once production starts, unless we agree in writing.
- Last-Minute Cancellation: If you cancel within two weeks of the agreed delivery date, you owe the full invoice amount.
- Return Requirements: Returns need our written consent and are generally refused if Products are damaged, used, or not in original packaging, or if more than 30 days have passed. Special-condition or custom items are also excluded.
- Your Confirmation: You must confirm no prohibitions apply when requesting a return. We decide if the Products qualify for credit, exchange, or rejection based on their condition upon arrival.
- US Consumer Returns & Right of Withdrawal: If you are purchasing from the United States, our refund and return policies comply with applicable federal and state laws. Consumers in states that mandate return policies (e.g., California) may be entitled to additional rights.
If applicable state or federal laws provide greater return rights than those stated here, those laws take precedence. Unless legally required otherwise, returns must comply with the conditions outlined in these Terms.
- Shipping Costs: Additional shipping or handling fees may apply if the Product is returned from outside our usual service areas.
Article 10: Suspension and Termination
- Immediate Grounds: We may suspend or terminate the Agreement if:
- You breach essential terms and fail to fix the issue within 7 days of notice.
- You face bankruptcy, liquidation, or substantially cease business.
- Your finances deteriorate significantly, risking non-payment.
- You fail to provide required security or breach payment terms.
- Consequences: We can claim damages and demand immediate payment of all outstanding invoices plus interest. Termination does not affect accrued rights predating termination.
Article 11: Retention of Title
- Ownership: We retain ownership of all delivered Products until you settle all obligations under any Agreement with us. Title passes only after all payments are completed.
- Right to Repossess: If you fail to meet obligations or if we suspect non-compliance, we may reclaim the Products still under retention of title. You must fully cooperate.
- Third-Party Claims: You must inform us promptly if a third party attempts to seize or claim rights over our retained Products.
- Insurance and Protection: We may require you to insure the Products, assign any insurance claims to us, label them as our property, and assist in protecting our ownership rights.
Article 12: Conformity, Inspection, and Complaints
- Basic Quality: We ensure Products meet usual requirements for normal use at delivery. Natural materials (like wood) may shift or crack, which is not considered a defect.
- Inspection on Receipt: Upon delivery, verify that the Products match the Agreement in type, quantity, and condition, and note any visible damage.
- Visible vs. Non-Visible Defects: Report visible defects in writing within 14 days of delivery; non-visible defects within 14 days of discovery (but not beyond 3 months). Late reporting may forfeit your rights.
- Minor Variations: Small color or size variations do not justify a complaint. If a complaint is valid, we may offer a refund, price reduction, repair, or replacement.
- Obligations During Complaints: Even with a timely complaint, you must still pay and accept the Products unless we agree otherwise. Returns are only possible with prior written approval.
Article 13: Prices and Price Increases
- Sales Tax: Quoted prices generally exclude sales tax unless clearly stated otherwise.
- Price Adjustment: Within 3 months of the Agreement, we may raise prices only if required by law. You may cancel within 14 days if that occurs. After 3 months, we can adjust prices for market or cost reasons.
Article 14: Liability and Indemnification
- Scope of Liability: We are liable only for direct damages caused by our gross negligence or willful misconduct, subject to the limits in this article.
- No Indirect Damages: We are not liable for indirect or consequential damages (e.g., lost profits, business disruption). For Consumers, these limitations apply as far as Dutch law permits (Article 7:24(2) BW).
- Indemnification by You: You indemnify us against third-party claims not directly caused by us. We are not responsible for any damage that occurs under your control or someone else’s.
- Liability Cap: Our liability is capped by our insurer’s payout. If the insurer does not pay, it is limited to the invoice value of the relevant Product.
- Exemptions: We are not liable for force majeure events (Article 15), nor for damages arising from usage at festivals or similarly uncontrolled environments.
- US Consumer Protections & Liability Limitations: If you are a Consumer in the United States, certain limitations of liability in this Agreement may not apply in states where such disclaimers are restricted (including but not limited to California, New York, Texas, and Florida).
Subject to applicable federal and state law, our Products are provided “As-Is” and “With All Faults” unless otherwise required by law. Certain states, including California, New York, and Texas, may prohibit disclaimers on implied warranties or product fitness for a particular purpose.
Magnuson-Moss Warranty Act Notice: If you purchase a warranted Product in the United States, your warranty rights are governed by the Magnuson-Moss Warranty Act, which may entitle you to specific legal rights in addition to the warranty terms stated here.
Article 15: Force Majeure
- Definition: Force majeure includes unforeseen events beyond our control—strikes, raw material shortages, natural disasters, government actions, etc.—that make performance impossible or unreasonably burdensome.
- Post-Obligation Invocation: If these conditions arise after we should have delivered, we can still invoke force majeure. We may suspend or cancel obligations without liability for damages.
- Partial Performance: If we partially fulfilled obligations before force majeure, we may invoice for that portion. Force majeure affecting our suppliers also counts as force majeure for us.
Article 16: Intellectual and Industrial Property
- No Removal of Notices: You may not remove or alter any trademarks, copyrights, or other proprietary labels from our Products or materials.
- Prohibition on Imitation: Imitating or reproducing our products/designs is banned, as is providing them to third parties who might replicate them.
- Penalties: Breaching these prohibitions incurs a fine of 5% of the Product’s purchase price (min. $500 per item). You must enforce this through a chain clause on your successors.
Article 17: Health & Safety Disclaimers
- No Medical Advice: We do not offer medical advice. If you have heart conditions, are pregnant, take medication, or have health concerns, consult a professional before using an Icetub or IceSauna.
- Age Restrictions: Our Products are not recommended for minors without direct adult supervision. An adult should be aware of potential risks before allowing a minor to use the Product.
- Setup & Maintenance: You must ensure installation complies with local electrical/building codes. If unsure, hire qualified professionals to avoid safety hazards.
- Heat/Cold Sensitivities: Prolonged or extreme temperature exposure can be dangerous. Stop using the Product if you feel dizzy, faint, or unwell, and seek medical help if needed.
- US Consumer Product Safety Notice: Our Products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.
Claims regarding health benefits of the Icetub or IceSauna are based on general wellness and fitness principles, not on FDA-approved studies.
If you have pre-existing health conditions, consult a physician before use.
FTC Advertising Disclosure: We comply with US Federal Trade Commission (FTC) guidelines regarding advertising claims. Any statements about health benefits are intended for general informational purposes only.
Article 18: Personal Injury Waiver / Assumption of Risk
- Inherent Risks: By using our Icetub or IceSauna, you acknowledge there are inherent risks, including—but not limited to—slipping, falling, heat/cold stress, fainting, or shock. You voluntarily assume these risks.
- Immediate Cessation of Use: If you experience any adverse symptoms (e.g., shortness of breath, dizziness), stop use immediately and seek medical advice.
- Minor Supervision: If minors are allowed to use the Product (e.g., in a family setting), direct supervision by a responsible adult is mandatory.
- Disclaimer of Liability: Subject to applicable law, we are not liable for personal injuries resulting from your improper, unsafe, or negligent use of the Product. This includes failure to follow recommended instructions and guidelines.
Article 19: Privacy
- Data Processing: We process personal data (for orders, deliveries, etc.) in accordance with the GDPR and our Privacy Statement at icetubs.com/privacy-statement.
- Policy Updates: We may update our Privacy Statement; changes take effect upon communication. We encourage you to review it periodically.
Article 20: Final Provisions
- Amendments: We can amend these Conditions at any time. Changes take effect on the date communicated or upon notification if no date is specified. If you are a Consumer and a significant amendment harms your rights, you may dissolve the Agreement under Article 6:237(c) BW.
- Exclusion of Certain Articles: Articles 7:404, 7:407(2), and 7:409 of the Dutch Civil Code do not apply.
- Legal Claims: All legal claims expire 1 year after they arise. Only Dutch law applies. The Vienna Sales Convention is excluded.
- Dispute Resolution: Consumers in the United States may bring legal proceedings in either Dutch courts or the courts of their state of residence, subject to mandatory local legal protections.
- Version Control: The latest version or the version valid at the time the legal relationship started applies.
- Legal Jurisdiction: These Terms are governed by Dutch law, except where US federal or state laws provide mandatory consumer protections. In the event of a conflict between these Terms and applicable US consumer laws, the latter shall take precedence.
