At Icetubs, we believe in transparency and fairness. Our Terms & Conditions outline the rights and responsibilities of both our customers and our company. By placing an order or using our services, you agree to these terms, ensuring a smooth and reliable experience for everyone. Please read them carefully.

Article 1 : Définitions
- « Nous” / “Nos » : Icetubs B.V., dont le siège est à Nieuwpoortkade 16 (1055 XG Amsterdam), enregistrée sous le n° 87358891, n° de TVA : NL864273952B01, en tant que vendeur.
- Icetub : Baignoire de haute qualité conçue pour une utilisation avec de l’eau glaciale ou chaude, destinée exclusivement à de l’eau naturelle sans produits chimiques ajoutés, sauf les additifs approuvés par Icetubs.
- IceSauna : Sauna de glace de haute qualité destiné exclusivement à la thérapie par la chaleur et à la relaxation.
- Produits : Tout Icetub, IceSauna ou accessoire associé vendu par nous.
- Vous : Toute partie (particulier ou entreprise) concluant un Accord avec nous ou recevant une offre de notre part dans le cadre de ces Conditions.
- Consommateur : Personne physique achetant un Produit pour un usage personnel et non commercial. En tant que Consommateur, ces Conditions s’appliquent sauf disposition légale contraire.
- Usage Professionnel et/ou Commercial : Tout achat destiné non pas strictement à un foyer privé, mais à un environnement commercial ou professionnel (p. ex., salles de sport, centres de bien-être).
- Accord : Le contrat entre vous et nous dans le cadre de ces Conditions, formé conformément aux étapes de l’Article 3.
- Conditions : Les présentes conditions générales, que nous pouvons mettre à jour conformément à l’Article 20.
- Droit de Rétractation : Une période de réflexion de 14 jours pour les Consommateurs (mais pas pour les non-consommateurs) permettant d’annuler un contrat à distance sans pénalité.
Article 2 : Applicabilité des présentes Conditions
- Champ d’Application : Ces Conditions régissent toutes les offres, devis et Accords —qu’ils soient via notre boutique en ligne ou autrement— entre nous en tant que vendeur/fournisseur et vous en tant qu’acheteur, sauf modification expresse par écrit.
- Rejet d’Autres Conditions : Nous rejetons expressément toutes autres conditions générales. Une dérogation ponctuelle ne renonce pas à notre droit d’application stricte future.
- Dispositions Invalides : Si une disposition est invalide ou nulle, les dispositions restantes restent en vigueur. Nous remplaçons la partie nulle par une disposition correspondant étroitement à son objectif initial.
- Incertitudes / Lacunes : Toute incertitude ou question non traitée doit être résolue d’une manière compatible avec ces Conditions.
Article 3 : Offre et Formation de l’Accord
- Offres Non Contraignantes : Nos offres sont non contraignantes sauf indication expresse contraire par écrit. Une offre peut expirer si le produit n’est plus disponible avant l’acceptation. Nous ne sommes pas liés par des erreurs évidentes (p. ex., de tarification).
- Détails de l’Offre : Chaque offre fournit suffisamment d’informations pour que vous compreniez vos droits et obligations lors de l’acceptation. Les images ou échantillons sont approximatifs et ne sont pas contraignants contractuellement.
- Formation de l’Accord : Un Accord est formé lorsque :
- Nous confirmons votre commande par écrit, ou
- Nous commençons à exécuter la commande de manière compatible avec l’acceptation (p. ex., préparation de l’expédition).
- Acceptation Déviante : Si votre acceptation diffère de notre offre, nous ne sommes pas liés sauf confirmation écrite. Les devis ou tarifs antérieurs ne s’appliquent pas automatiquement aux nouveaux Accords.
- Contrats à Distance avec les Consommateurs : En tant que Consommateur, l’Accord se forme dès que vous acceptez et remplissez les conditions énoncées. En cas d’acceptation électronique, nous confirmerons la réception sans délai.
- Mesures de Sécurité : Nous mettons en œuvre des mesures techniques et organisationnelles pour des transactions électroniques sécurisées. En tant que Consommateur, nous vous fournirons les détails essentiels sur un support durable avant ou lors de la livraison.
Article 4 : Livraison
- Principe Ex Works : Sauf accord écrit contraire, les Produits sont livrés départ usine (notre entrepôt). Vous assumez le risque/les coûts une fois que les Produits quittent nos installations.
- Acceptation et Transfert de Risque : Vous devez accepter la livraison lorsqu’elle vous est proposée. Le risque de perte, de dommage ou de dépréciation vous est transféré dès que les Produits vous sont remis, à votre mandataire ou au transporteur de votre choix.
- Accessibilité du Site : Vous êtes responsable de garantir l’accessibilité du lieu de livraison et d’obtenir les autorisations nécessaires. L’équipement spécialisé (p. ex., une grue) est à votre charge sauf accord contraire.
- Fourniture d’Informations : Nous ne commençons qu’après avoir reçu les données nécessaires de votre part. Le refus d’accepter la livraison ou l’absence d’instructions peut entraîner un stockage à vos risques et frais.
- Tiers : Nous pouvons faire appel à des transporteurs ou stocks tiers pour exécuter les commandes. En cas de délai de livraison manqué, vous devez nous en informer par écrit et accorder un délai raisonnable.
- Responsabilité en cas de Retard : Nous ne sommes pas responsables des retards dûs à la force majeure ou à des instructions incomplètes de votre part. Si nous manquons à livrer (hors force majeure) et que nous sommes en faute, notre responsabilité est limitée à la différence de prix si vous devez acheter un produit comparable ailleurs.
- Livraisons Partielles : Nous pouvons livrer en tranches, en facturant chacune séparément. Pour les Accords par phases, nous pouvons suspendre les phases suivantes jusqu’à votre approbation des résultats précédents.
- Livraisons Reportées ou Divisées : Si vous différez ou divisez les livraisons ou ne collectez pas les Produits, le risque est transféré une fois que nous les étiquettons comme étant les vôtres dans nos dossiers.
Article 5 : Utilisation Correcte de l’Icetub et de l’IceSauna
Cette section décrit les directives essentielles pour l’utilisation sûr et correcte de l’Icetub (bain de glace) et de l’IceSauna. Le non-respect de ces instructions peut entraîner des blessures, des dommages matériels ou l’annulation des réclamations de responsabilité.
I. Directives Générales de Sécurité (Applicables à l’Icetub et à l’IceSauna)
- Instructions du Fabricant & Conformité Locale
- Respectez toujours les directives officielles d’installation, de fonctionnement et de maintenance.
- L’installation doit être conforme aux réglementations électriques et de sécurité locales. En cas de doute, faites appel à un professionnel qualifié.
- Comportement de l’Utilisateur & Avertissements Sanitaires
- Sans Alcool ni Drogues : N’utilisez aucun des deux produits sous l’influence de l’alcool, de drogues ou de médicaments susceptibles d’altérer le jugement.
- Avis Médical : Les personnes souffrant de maladies cardiaques, d’hypertension, de problèmes respiratoires, de troubles circulatoires ou d’autres problèmes de santé doivent consulter un médecin avant utilisation.
- Surveillance des Mineurs : Les enfants de moins de 16 ans ne doivent utiliser l’Icetub ou l’IceSauna que sous surveillance directe d’un adulte.
- Arrêt Immédiat de l’Utilisation : Arrêtez immédiatement et consultez un médecin si vous ressentez des vertiges, une difficulté à respirer, un engourdissement ou un malaise.
- Sécurité Électrique & Installation
- Utilisez toujours une source d’alimentation correctement mise à la terre et protégée de l’exposition à l’eau.
- Utilisation Correcte des Rallonges : N’utilisez que des rallonges correctement mises à la terre et adaptées aux exigences de puissance de l’Icetub.
- Inspections Régulières : Vérifiez fréquemment les câbles d’alimentation, les prises et les composants électriques pour détecter tout dommage ou usure.
- Emplacement du Tableau Électrique : Le tableau électrique ne doit pas reposer directement sur le sol. Il doit être protégé contre une exposition excessive à l’eau et idéalement monté le long du mur sous la prise de courant.
- Emplacement & Considérations Environnementales
- Surface Stable : Placez sur une surface de niveau et antidérapante pour éviter le basculement ou les chutes.
- Ventilation : Si utilisé à l’intérieur, assurez une circulation d’air adéquate pour éviter la surchauffe, la condensation ou l’apauvrissement en oxygène.
- Risques d’Incendie & de Fumée : N’utilisez pas de flammes nues, de bougies ou de matériaux inflammables à l’intérieur ou à proximité des deux produits.
II. Directives Spécifiques à l’Icetub
- Restrictions d’Utilisation en Extérieur
- Précaution en dessous de -5°C : Ne faites pas fonctionner l’Icetub en extérieur en dessous de -5°C. Débranchez l’unité de refroidissement et rangez-la à l’intérieur.
- Entre -5°C et 1°C : Faites fonctionner le moteur de refroidissement en mode « automatique » 24h/24 et 7j/7, avec tous les minuteries éteintes, pour éviter le gel.
- Conditions Météorologiques Extrêmes : Évitez l’utilisation lors d’orages, de foudre ou de conditions météorologiques extrêmes.
- Utilisation Solitaire : N’utilisez jamais l’Icetub en extérieur seul. Assurez-vous que quelqu’un est au courant de votre séance.
- Qualité de l’Eau & Maintenance
- Additifs Approuvés Uniquement : N’utilisez que le traitement d’eau AquaFinesse d’Icetubs pour la maintenance standard. Évitez le brome, les sels ou d’autres produits chimiques non autorisés.
- Changements d’Eau Réguliers : Changez l’eau et les filtres régulièrement selon l’utilisation.
- Tests de l’Eau (Pour les Clients Professionnels) : Les environnements à forte utilisation doivent effectuer des tests périodiques de la qualité de l’eau.
- Restrictions d’Utilisation en Intérieur
- Pas d’Utilisation Sans Surveillance : N’utilisez jamais l’Icetub seul à l’intérieur.
III. Directives Spécifiques à l’IceSauna
- Limites de Température & d’Exposition
- Limites de Temps : La durée de séance recommandée est de 15 à 30 minutes avec des pauses.
- Hydratation : Restez bien hydrатé(e) avant et après l’utilisation.
- Sensibilisation de l’Utilisateur : Si vous vous sentez étourdi(e), mal ou en surchauffe, sortez immédiatement et rafraîchissez-vous.
- Emplacement & Sécurité d’Utilisation
- Conditions Météorologiques Extrêmes : Évitez d’utiliser l’IceSauna lors d’orages, de foudre ou de vents violents.
- Ventilation Intérieure : Assurez une circulation d’air adéquate pour éviter l’accumulation de chaleur ou l’apauvrissement en oxygène.
- Tenue Appropriée : Portez des vêttements respirants et adaptés au sauna ; évitez les tissus lourds ou synthétiques.
- Pas d’Utilisation Sans Surveillance : N’utilisez jamais l’IceSauna seul(e).
IV. Acceptation des Risques & Décharge de Responsabilité
- Acceptation Volontaire des Risques
- En utilisant l’Icetub ou l’IceSauna, vous reconnaissez et acceptez les risques inhérents associés à l’exposition à la température, aux équipements électriques et à la sécurité aquatique.
- Aucune Responsabilité en cas de Mauvaise Utilisation
- Icetubs B.V. n’est pas responsable des blessures, dommages ou complications de santé résultant d’une utilisation incorrecte, du non-respect des instructions ou d’un comportement dangereux.
- Conséquences d’une Mauvaise Utilisation du Produit
- Tout dommage causé par des modifications non autorisées, une utilisation inappropriée de produits chimiques ou une négligence annulera toute réclamation de défaut produit.
Article 6 : Échantillons, Modèles et Données
- Valeur Indicative Uniquement : Les modèles, échantillons ou dessins que nous fournissons sont des approximations ; les Produits réels peuvent légèrement différer.
- Modifications de Données : Nous pouvons mettre à jour ou modifier des catalogues, des spécifications techniques ou des données sans préavis ; ces matériaux ne sont pas contraignants sauf confirmation écrite.
- Quantités Minimales : Nous nous réservons le droit de fixer des quantités minimales de commande pour certains Produits.
- Propriété des Matériaux : Les modèles ou échantillons que nous fournissons restent notre propriété sauf accord écrit contraire.
Article 7 : Paiement ; Intérêts et Frais de Recouvrement
- Délai de Paiement : Sauf indication contraire, les factures sont payables dans les 30 jours suivant la date de facturation, sans escompte ni compensation, sur notre compte bancaire (NL86 RABO 0319 5907 12, Icetubs B.V.).
- Défaut : Le non-paiement dans les délais vous met automatiquement en défaut. Les intérêts légaux courent à partir de la date d’échéance. En cas de liquidation, faillite ou restructuration de dettes, toutes les sommes deviennent immédiatement exigibles.
- Litiges de Facturation : Contester une facture ne suspend pas l’obligation de paiement.
- Évaluation du Crédit : Nous pouvons vérifier votre solvabilité et, si justifié, refuser une commande ou appliquer des conditions particulières.
- Réclamations de Facturation : Les objections écrites doivent être soumises dans les 30 jours suivant la date de facturation.
- Frais de Recouvrement : En cas de défaut, vous devez des intérêts légaux plus des frais de recouvrement extrajudiciaires. Tous les coûts supplémentaires nécessaires (y compris les honoraires d’avocat) sont également à votre charge.
Article 8 : Modifications des Produits ou des Circonstances
- Modifications Mineures : Nous pouvons apporter des améliorations mineures requises par la loi ou bénéfiques pour la qualité du produit, à condition qu’elles ne modifient pas les caractéristiques essentielles.
- Changements Significatifs : Si des facteurs imprévus surviennent, l’une ou l’autre partie peut demander des modifications par souci d’équité. Les coûts supplémentaires dus à vos actions vous seront facturés.
- Mises à Jour d’Adresse : Vous devez nous informer immédiatement par écrit de tout changement d’adresse.
Article 9 : Annulation, Retour et Droit de Rétractation
- Frais d’Annulation : L’annulation (totale ou partielle) avant la livraison vous oblige à rembourser nos coûts raisonnables et tout dommage direct ou indirect. Les commandes personnalisées ne peuvent pas être annulées une fois la production commencée.
- Annulation de Dernière Minute : Si vous annulez dans les deux semaines précédant la date de livraison convenue, vous devez le montant total de la facture.
- Conditions de Retour : Les retours nécessitent notre accord écrit et sont généralement refusés si les Produits sont endommagés, utilisés ou ne sont pas dans leur emballage d’origine, ou si plus de 30 jours se sont écoulés.
- Votre Confirmation : Vous devez confirmer qu’aucune interdiction ne s’applique lors de la demande de retour.
- Droit de Rétractation du Consommateur : Les Consommateurs disposent de 14 jours à compter de la réception pour se rétracter d’un contrat à distance sans motif. Si un paiement a été effectué, nous remboursons dans les 14 jours suivant la réception des Produits ou la preuve de retour.
- Frais de Port : Des frais d’expédition ou de manutention supplémentaires peuvent s’appliquer si le Produit est retourné depuis l’extérieur de nos zones de service habituelles.
Article 10 : Suspension et Résiliation
- Motifs Immédiats : Nous pouvons suspendre ou résilier l’Accord si :
- Vous violez des conditions essentielles et ne résolvez pas le problème dans les 7 jours suivant la notification.
- Vous faites l’objet d’une faillite, d’une liquidation ou cessez substantiellement vos activités.
- Votre situation financière se détériore significativement, risquant le non-paiement.
- Vous ne fournissez pas la garantie requise ou violez les conditions de paiement.
- Conséquences : Nous pouvons réclamer des dommages et exiger le paiement immédiat de toutes les factures en souffrance plus les intérêts.
Article 11 : Réserve de Propriété
- Propriété : Nous conservons la propriété de tous les Produits livrés jusqu’à ce que vous ayez réglé toutes les obligations dans le cadre de tout Accord avec nous.
- Droit de Récupération : Si vous ne respectez pas vos obligations, nous pouvons récupérer les Produits soumis à la réserve de propriété. Vous devez coopérer pleinement.
- Revendications de Tiers : Vous devez nous informer immédiatement si un tiers tente de saisir ou de revendiquer des droits sur nos Produits retenus.
- Assurance et Protection : Nous pouvons vous demander d’assurer les Produits et de nous aider à protéger nos droits de propriété.
Article 12 : Conformité, Inspection et Réclamations
- Qualité de Base : Nous garantissons que les Produits répondent aux exigences habituelles pour un usage normal lors de la livraison.
- Inspection à la Réception : À la livraison, vérifiez que les Produits correspondent à l’Accord en termes de type, de quantité et d’état, et notez tout dommage visible.
- Défauts Visibles vs. Non Visibles : Signalez les défauts visibles par écrit dans les 14 jours suivant la livraison ; les défauts non visibles dans les 14 jours suivant leur découverte (mais pas au-delà de 3 mois).
- Variations Mineures : Les petites variations de couleur ou de taille ne justifient pas une réclamation.
- Obligations Pendant les Réclamations : Même avec une réclamation dans les délais, vous devez payer et accepter les Produits sauf accord contraire.
Article 13 : Prix et Augmentations de Prix
- TVA : Les prix cités excluent généralement la TVA à 21 % sauf indication contraire claire.
- Ajustement des Prix : Dans les 3 mois suivant l’Accord, nous ne pouvons augmenter les prix que si la loi l’exige. Vous pouvez annuler dans les 14 jours si cela se produit. Après 3 mois, nous pouvons ajuster les prix pour des raisons de marché ou de coûts.
Article 14 : Responsabilité et Indemnisation
- Étendue de la Responsabilité : Nous sommes responsables uniquement des dommages directs causés par notre négligence grave ou notre faute intentionnelle.
- Pas de Dommages Indirects : Nous ne sommes pas responsables des dommages indirects ou consécutifs (p. ex., perte de profits, interruption d’activité).
- Indemnisation par Vous : Vous nous indemnisez contre les réclamations de tiers non directement causées par nous.
- Plafond de Responsabilité : Notre responsabilité est plafonnée par le versement de notre assureur.
- Exemptions : Nous ne sommes pas responsables des événements de force majeure (Article 15), ni des dommages découlant d’une utilisation lors de festivals ou d’environnements similairement non contrôlés.
Article 15 : Force Majeure
- Définition : La force majeure comprend les événements imprévisibles hors de notre contrôle —grèves, pénuries de matières premières, catastrophes naturelles, actions gouvernementales, etc.— qui rendent l’exécution impossible ou déraisonnablement lourde.
- Invocation Post-Obligation : Nous pouvons invoquer la force majeure même après la date à laquelle nous aurions dû livrer. Nous pouvons suspendre ou annuler des obligations sans responsabilité pour dommages.
- Exécution Partielle : Si nous avons partiellement rempli des obligations avant la force majeure, nous pouvons facturer cette partie.
Article 16 : Propriété Intellectuelle et Industrielle
- Pas de Suppression d’Avis : Vous ne pouvez pas supprimer ou modifier les marques, les droits d’auteur ou d’autres étiquettes de propriété sur nos Produits ou matériaux.
- Interdiction d’Imitation : Imiter ou reproduire nos produits/designs est interdit.
- Pénalités : La violation de ces interdictions entraîne une amende de 5 % du prix d’achat du Produit (min. 500 € par article).
Article 17 : Avertissements Sanitaires & Sécurité
- Pas de Conseil Médical : Nous ne donnons pas de conseils médicaux. En cas de maladies cardiaques, de grossesse, de prise de médicaments ou de problèmes de santé, consultez un professionnel avant d’utiliser un Icetub ou une IceSauna.
- Restrictions d’Âge : Nos Produits ne sont pas recommandés aux mineurs sans supervision directe d’un adulte.
- Installation & Maintenance : Vous devez vous assurer que l’installation est conforme aux codes électriques/de construction locaux.
- Sensibilités Chaleur/Froid : Une exposition prolongée ou extrême aux températures peut être dangereuse. Arrêtez d’utiliser le Produit si vous vous sentez étourdi(e), évanoui(e) ou souffrant.
Article 18 : Renonciation aux Blessures Corporelles / Acceptation des Risques
- Risques Inhérents : En utilisant notre Icetub ou IceSauna, vous reconnaissez qu’il existe des risques inhérents, notamment —mais sans s’y limiter— les glissades, chutes, stress thermique/froid, évanouissement ou choc. Vous assumez volontairement ces risques.
- Arrêt Immédiat : Si vous ressentez des symptômes néfastes (p. ex., difficulté à respirer, vertiges), arrêtez immédiatement et consultez un médecin.
- Surveillance des Mineurs : Si des mineurs sont autorisés à utiliser le Produit, la supervision directe d’un adulte responsable est obligatoire.
- Décharge de Responsabilité : Sous réserve du droit applicable, nous ne sommes pas responsables des blessures corporelles résultant d’une utilisation incorrecte, dangereuse ou négligente du Produit.
Article 19 : Confidentialité
- Traitement des Données : Nous traitons les données personnelles (pour les commandes, les livraisons, etc.) conformément au RGPD et à notre Politique de Confidentialité sur icetubs.com/privacy-statement.
- Mises à Jour de la Politique : Nous pouvons mettre à jour notre Politique de Confidentialité ; les modifications prennent effet lors de leur communication.
Article 20 : Dispositions Finales
- Amendements : Nous pouvons modifier ces Conditions à tout moment. Les modifications prennent effet à la date communiquée.
- Exclusion de Certains Articles : Les articles 7:404, 7:407(2) et 7:409 du Code Civil néerlandais ne s’appliquent pas.
- Réclamations Légales : Toutes les réclamations légales expirent 1 an après leur naissance. Seul le droit néerlandais s’applique.
- Résolution des Litiges : Les litiges sont soumis au tribunal compétent d’Amsterdam, Pays-Bas.
- Contrôle de Version : La dernière version ou la version valide au moment du début de la relation juridique s’applique.

Article 1: Definitions
- “We” / “Us”: Icetubs B.V., located at Nieuwpoortkade 16, (1055 XG Amsterdam), registered under no. 87358891, VAT no. NL864273952B01, acting as the seller.
- Icetub: A high-quality tub designed for both ice-cold and hot water use, intended exclusively for natural water with no added chemicals, except for additives approved by Icetubs
- IceSauna: A high-quality ice sauna intended exclusively for heat therapy and relaxation.
- Products: Any Icetubs, IceSaunas, or related accessories sold by us.
- You: Any party (individual or business) entering into an Agreement with us or receiving an offer from us under these Conditions.
- Consumer: A natural person purchasing a Product for personal, non-commercial use. If you are a Consumer, these Conditions apply unless otherwise specified by law (e.g., Consumer Rights Act 2015).
- Professional and/or Business Use: Any purchase not strictly for a single private household, but for a commercial or professional setting (e.g., gyms, wellness centers).
- Agreement: The contract between you and us under these Conditions, formed according to the steps in Article 3.
- Conditions: These general terms and conditions, which we may update under Article 20.
- Right of Withdrawal: A 14-day cooling-off period for Consumers (but not for non-consumers) to cancel a distance contract without penalty.
Article 2: Applicability of These Conditions
- Scope: These Conditions govern all offers, quotations, and Agreements—whether via our webshop or otherwise—between us as seller/supplier and you as purchaser, unless explicitly modified in writing.
- Rejection of Other Terms: We expressly reject any other general terms and conditions. These Conditions also apply to all Agreements involving third parties. Deviating once does not waive our right to future strict adherence.
- Invalid Provisions: If any provision is invalid or void, the remaining provisions remain in effect. We will replace the null or voided part with one closely matching its original purpose.
- Uncertainties / Gaps: Any uncertainties or unaddressed issues must be resolved in a way consistent with these Conditions.
- Consumer Rights Act 2015: If you are a Consumer in the United Kingdom, your statutory rights under the Consumer Rights Act 2015 will apply where applicable. If any clause in these Terms contradicts your statutory rights, the Consumer Rights Act 2015 will take precedence
Article 3: Offer and Formation of Agreement
- Non-Binding Offers: Our offers are non-binding unless explicitly stated otherwise in writing. An offer may expire if the product becomes unavailable before acceptance. We are not bound by obvious errors (e.g., in pricing).
- Offer Details: Each offer provides enough information for you to understand your rights and obligations on acceptance. Images or samples are approximate and not contractually binding.
- Agreement Formation: An Agreement is formed when:
- We confirm your order in writing, or
- We begin fulfilling the order in a manner consistent with acceptance (e.g., preparing shipment).
- Deviating Acceptance: If your acceptance differs from our offer, we are not bound unless we confirm in writing. Past quotations or rates do not automatically apply to new Agreements.

- Site Accessibility: You are responsible for ensuring the delivery site is accessible and for acquiring any required permits. Specialized equipment (e.g., a crane) is at your expense unless otherwise agreed.
- Information Provision: We only start after receiving any necessary data from you. Failure to accept delivery or provide instructions may result in storage at your risk and cost.
- Third Parties: We may use third-party couriers or stocks to fulfill orders. If a delivery date is missed, you must notify us in writing and allow a reasonable period for delivery.
- Liability for Delay: We are not liable for delays due to force majeure or incomplete instructions from you. If we fail to deliver (outside force majeure) and are at fault, our liability is limited to the price difference if you must buy a comparable product elsewhere.
- Partial Deliveries: We may deliver in installments, invoicing each separately. For phased Agreements, we may pause subsequent phases until you approve previous results.
- Postponed or Split Deliveries: If you defer or split deliveries or do not collect the Products, risk transfers once we label them as yours in our records. We may then invoice and charge storage or transport fees.
- UK Import Responsibilities: If you are purchasing from the United Kingdom, you are responsible for paying any applicable import duties, customs tariffs, or local taxes upon arrival. It is your responsibility to ensure compliance with UK product regulations unless we explicitly confirm conformity in writing.

I. General Safety Guidelines (Applies to Both Icetub & IceSauna)
- Manufacturer Instructions & Local Compliance
- Always follow official setup, operation, and maintenance guidelines.
- Installation must comply with local electrical and safety regulations. If uncertain, hire a qualified professional.
- User Conduct & Health Warnings
- No Alcohol or Drug Use: Do not use either product while under the influence of alcohol, drugs, or medications that may impair judgment.
- Medical Advisory: Individuals with heart conditions, high blood pressure, respiratory issues, circulatory disorders, or other health concerns should consult a physician before use.
- Minor Supervision: Children under 16 years must only use the Icetub or IceSauna under direct adult supervision.
- Immediate Cessation of Use: Stop use immediately and seek medical attention if you experience dizziness, shortness of breath, numbness, or discomfort.
- Electrical & Installation Safety
- Always use a properly grounded power source protected from water exposure.
- Proper Extension Cord Use: Only use extension cords that are properly grounded and rated for the Icetub’s power requirements. Avoid ungrounded or low-capacity cords, as they may cause overheating or fire hazards. Plug directly into a dedicated power outlet whenever possible.
- Regular Inspections: Frequently check power cords, plugs, and electrical components for damage or wear.
- Fusebox Placement: The fusebox must not rest directly on the ground. It should be protected from excessive water exposure and ideally mounted along the wall below the power plug.
- Water Resistance Limitation: While the fusebox is water-resistant, it is not designed to withstand prolonged submersion or being placed in standing water (e.g., puddles). Ensure proper installation to prevent damage.
- Placement & Environmental Considerations
- Stable Surface: Place on a level, non-slippery surface to prevent tipping or falls.
- Ventilation: If used indoors, ensure proper airflow to prevent overheating, condensation, or oxygen depletion.
- Fire & Smoke Hazards: Do not use open flames, candles, or flammable materials inside or near either product.
II. Icetub-Specific Guidelines
- Outdoor Use Restrictions
- Under -5°C precaution: Do not operate the Icetub outdoors below -5°C. Detach the cooling unit and store it indoors to prevent damage.
- Between -5°C and 1°C: Operate the cooling engine on “automatic” mode 24/7, with all timers off, to prevent freezing.
- Severe Weather: Avoid use during thunderstorms, lightning, or extreme weather.
- Solo Use: Never use the Icetub outdoors alone. Ensure someone is aware of your session.
- Water Quality & Maintenance
- Approved Additives Only: Use only Icetubs’ AquaFinesse water treatment for standard maintenance. Professional clients using the Hanna system provided by Icetubs may use chlorine as needed, following proper dilution and safety guidelines. Avoid bromine, salts, or other unauthorized chemicals, as they may corrode components.
- Regular Water Changes: Change the water and filters regularly based on usage to maintain hygiene and system longevity.
- Water Testing (For Professional Clients): High-use environments, such as gyms and wellness centers, should conduct periodic water quality testing to ensure compliance with local hygiene and safety standards.
- Indoor Use Restrictions
- No Unattended Use: Never use the Icetub alone indoors. Ensure someone is aware of your session.
III. IceSauna-Specific Guidelines
- Temperature & Exposure Limits
- Time Limits: Recommended session duration is 15–30 minutes with breaks in between.
- Hydration: Stay properly hydrated before and after use to avoid dehydration or heat exhaustion.
- User Awareness: If you feel lightheaded, unwell, or overheated, exit immediately and cool down.
- Placement & Usage Safety
- Extreme Weather: Avoid using the IceSauna during thunderstorms, lightning, or high winds.
- Indoor Ventilation: Ensure adequate airflow to prevent heat buildup or oxygen depletion.
- Appropriate Attire: Wear breathable, sauna-appropriate clothing; avoid heavy or synthetic fabrics.
- No Unattended Use: Never use the Icesauna alone. Ensure someone is aware of your session.
IV. Assumption of Risk & Liability Disclaimer
- Voluntary Risk Acceptance

- No Liability for Misuse
- Icetubs B.V. is not liable for injuries, damages, or health complications resulting from improper use, failure to follow instructions, or unsafe behavior.
- Product Misuse Consequences
- Any damage caused by unauthorized modifications, improper chemical use, or negligence will void any product defect claims or liability considerations.
Article 6: Samples, Models, and Data
- Indicative Only: Models, samples, or drawings we provide are approximations; actual Products may differ slightly, especially if made from natural materials.
- Data Modifications: We may update or alter catalogs, technical specs, or data without notice; such materials are not binding unless confirmed in writing.
- Minimum Quantities: We reserve the right to set minimum order quantities for certain Products.
- Ownership of Materials: Any models or samples we supply remain ours unless agreed otherwise in writing; those you supply remain yours.
Article 7: Payment; Interest and Collection Costs
- Payment Deadline: Unless stated otherwise, invoices are payable within 30 days of the invoice date, without discount or setoff, to our bank (NL86 RABO 0319 5907 12, Icetubs B.V.).
- Default: Failing to pay on time places you in default automatically. Statutory interest accrues from the due date. If you face liquidation, bankruptcy, or debt restructuring, all sums become immediately payable.
- Invoice Disputes: Disputing an invoice does not suspend payment. Payments first cover accrued interest/costs, then the oldest unpaid invoice.
- Credit Assessment: We may check your creditworthiness. If justified, we can refuse an order or apply special terms. We can also request a deposit or other security before delivery; refusal is a breach.
- Invoice Complaints: Written objections must be lodged within 30 days of the invoice date. Otherwise, we assume acceptance. If you have paid, we consider you to have agreed with its contents.
- Collection Costs: If you are in default, you owe statutory interest plus extrajudicial collection costs per the Dutch Order of Advocates. Any higher necessary costs (including legal fees) are also yours.
Article 8: Changes in Products or Circumstances
- Minor Modifications: We may make minor improvements required by law or beneficial to product quality, provided they do not alter essential features.
- Significant Changes: If unexpected factors emerge—unknown at the Agreement’s inception—either party may request modifications for fairness. Additional costs due to your actions are billed to you.
- Address Updates: You must inform us of address changes in writing immediately. Deliveries to your last known address are deemed delivered.
Article 9: Cancellation, Return Shipment, and Right of Withdrawal
- Cancellation Costs: Canceling (in whole or part) before delivery obligates you to reimburse our reasonable costs and any direct or indirect damages. Personalized/custom orders cannot be canceled once production starts, unless we agree in writing.
- Last-Minute Cancellation: If you cancel within two weeks of the agreed delivery date, you owe the full invoice amount.
- Return Requirements: Returns need our written consent and are generally refused if Products are damaged, used, or not in original packaging, or if more than 30 days have passed. Special-condition or custom items are also excluded.
- Your Confirmation: You must confirm no prohibitions apply when requesting a return. We decide if the Products qualify for credit, exchange, or rejection based on their condition upon arrival.
- Consumer Right of Withdrawal: Consumers in the United Kingdom have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel an order for most Products within 14 days of receiving them. This does not apply to custom-made or perishable goods
- Shipping Costs: Additional shipping or handling fees may apply if the Product is returned from outside our usual service areas.
- Additional UK Consumer Rights: If you are a Consumer in the United Kingdom, local legislation may grant you extra or different return/cancellation rights than those stated here. In case of conflict, those local rights prevail.
Article 10: Suspension and Termination
- Immediate Grounds: We may suspend or terminate the Agreement if:
- You breach essential terms and fail to fix the issue within 7 days of notice.
- You face bankruptcy, liquidation, or substantially cease business.
- Your finances deteriorate significantly, risking non-payment.
- You fail to provide required security or breach payment terms.
- Consequences: We can claim damages and demand immediate payment of all outstanding invoices plus interest. Termination does not affect accrued rights predating termination.
Article 11: Retention of Title
- Ownership: We retain ownership of all delivered Products until you settle all obligations under any Agreement with us. Title passes only after all payments are completed.
- Right to Repossess: If you fail to meet obligations or if we suspect non-compliance, we may reclaim the Products still under retention of title. You must fully cooperate.
- Third-Party Claims: You must inform us promptly if a third party attempts to seize or claim rights over our retained Products.
- Insurance and Protection: We may require you to insure the Products, assign any insurance claims to us, label them as our property, and assist in protecting our ownership rights.
Article 12: Conformity, Inspection, and Complaints
- Basic Quality: We ensure Products meet usual requirements for normal use at delivery. Natural materials (like wood) may shift or crack, which is not considered a defect.
- Inspection on Receipt: Upon delivery, verify that the Products match the Agreement in type, quantity, and condition, and note any visible damage.
- Visible vs. Non-Visible Defects: Report visible defects in writing within 14 days of delivery; non-visible defects within 14 days of discovery (but not beyond 3 months). Late reporting may forfeit your rights.
- Minor Variations: Small color or size variations do not justify a complaint. If a complaint is valid, we may offer a refund, price reduction, repair, or replacement.
- Obligations During Complaints: Even with a timely complaint, you must still pay and accept the Products unless we agree otherwise. Returns are only possible with prior written approval.
Article 13: Prices and Price Increases
- VAT: Quoted prices generally exclude 20% VAT unless clearly stated otherwise.
- Price Adjustment: Within 3 months of the Agreement, we may raise prices only if required by law. You may cancel within 14 days if that occurs. After 3 months, we can adjust prices for market or cost reasons.
Article 14: Liability and Indemnification
- Scope of Liability: We are liable only for direct damages caused by our gross negligence or willful misconduct, subject to the limits in this article.
- No Indirect Damages: We are not liable for indirect or consequential damages (e.g., lost profits, business disruption). For Consumers, these limitations apply as far as Dutch law permits (Article 7:24(2) BW).
- Indemnification by You: You indemnify us against third-party claims not directly caused by us. We are not responsible for any damage that occurs under your control or someone else’s.
- Liability Cap: Our liability is capped by our insurer’s payout. If the insurer does not pay, it is limited to the invoice value of the relevant Product.
- Exemptions: We are not liable for force majeure events (Article 15), nor for damages arising from usage at festivals or similarly uncontrolled environments.
- Mandatory Local Laws: UK law does not permit disclaimers or limitations of certain implied warranties or liabilities. If so, any conflicting limitations in these Conditions do not apply to the extent prohibited by local law.
Article 15: Force Majeure
- Definition: Force majeure includes unforeseen events beyond our control—strikes, raw material shortages, natural disasters, government actions, etc.—that make performance impossible or unreasonably burdensome.
- Post-Obligation Invocation: If these conditions arise after we should have delivered, we can still invoke force majeure. We may suspend or cancel obligations without liability for damages.
- Partial Performance: If we partially fulfilled obligations before force majeure, we may invoice for that portion. Force majeure affecting our suppliers also counts as force majeure for us.
Article 16: Intellectual and Industrial Property
- No Removal of Notices: You may not remove or alter any trademarks, copyrights, or other proprietary labels from our Products or materials.
- Prohibition on Imitation: Imitating or reproducing our products/designs is banned, as is providing them to third parties who might replicate them.
- Penalties: Breaching these prohibitions incurs a fine of 5% of the Product’s purchase price (min. £500 per item). You must enforce this through a chain clause on your successors.
Article 17: Health & Safety Disclaimers
- No Medical Advice: We do not offer medical advice. If you have heart conditions, are pregnant, take medication, or have health concerns, consult a professional before using an Icetub or IceSauna.
- Age Restrictions: Our Products are not recommended for minors without direct adult supervision. An adult should be aware of potential risks before allowing a minor to use the Product.
- Setup & Maintenance: You must ensure installation complies with local electrical/building codes. If unsure, hire qualified professionals to avoid safety hazards.
- Heat/Cold Sensitivities: Prolonged or extreme temperature exposure can be dangerous. Stop using the Product if you feel dizzy, faint, or unwell, and seek medical help if needed.
Article 18: Personal Injury Waiver / Assumption of Risk
- Inherent Risks: By using our Icetub or IceSauna, you acknowledge there are inherent risks, including—but not limited to—slipping, falling, heat/cold stress, fainting, or shock. You voluntarily assume these risks.
- Immediate Cessation of Use: If you experience any adverse symptoms (e.g., shortness of breath, dizziness), stop use immediately and seek medical advice.
- Minor Supervision: If minors are allowed to use the Product (e.g., in a family setting), direct supervision by a responsible adult is mandatory.
- Disclaimer of Liability: Subject to applicable law, we are not liable for personal injuries resulting from your improper, unsafe, or negligent use of the Product. This includes failure to follow recommended instructions and guidelines.
Article 19: Privacy
- Data Processing: We process personal data (for orders, deliveries, etc.) in accordance with the GDPR and our Privacy Statement at icetubs.com/privacy-statement.
- Policy Updates: We may update our Privacy Statement; changes take effect upon communication. We encourage you to review it periodically.
Article 20: Final Provisions
- Amendments: We can amend these Conditions at any time. Changes take effect on the date communicated or upon notification if no date is specified. If you are a Consumer and a significant amendment harms your rights, you may dissolve the Agreement under Article 6:237(c) BW.
- Exclusion of Certain Articles: Articles 7:404, 7:407(2), and 7:409 of the Dutch Civil Code do not apply.
- Legal Claims: All legal claims expire 1 year after they arise. Only Dutch law applies. The Vienna Sales Convention is excluded.
- Dispute Resolution: Disputes go to the competent court in Amsterdam, Netherlands, unless another court is mandated by law.
- Version Control: The latest version or the version valid at the time the legal relationship started applies.
- Legal Jurisdiction: These Terms are governed by Dutch law. However, if you are a Consumer in the United Kingdom, you may bring legal proceedings either in the Netherlands or in the UK courts where you reside, in accordance with UK consumer law.

- No Unattended Use: Never use the Icesauna alone. Ensure someone is aware of your session.
IV. Assumption of Risk & Liability Disclaimer
- Voluntary Risk Acceptance
- By using the Icetub or IceSauna, you acknowledge and accept the inherent risks associated with temperature exposure, electrical equipment, and water safety.
- No Liability for Misuse
- Icetubs B.V. is not liable for injuries, damages, or health complications resulting from improper use, failure to follow instructions, or unsafe behavior.
- Product Misuse Consequences
- Any damage caused by unauthorized modifications, improper chemical use, or negligence will void any product defect claims or liability considerations.
Article 6: Samples, Models, and Data
- Indicative Only: Models, samples, or drawings we provide are approximations; actual Products may differ slightly, especially if made from natural materials.
- Data Modifications: We may update or alter catalogs, technical specs, or data without notice; such materials are not binding unless confirmed in writing.
- Minimum Quantities: We reserve the right to set minimum order quantities for certain Products.
- Ownership of Materials: Any models or samples we supply remain ours unless agreed otherwise in writing; those you supply remain yours.
Article 7: Payment; Interest and Collection Costs
- Payment Deadline: Unless stated otherwise, invoices are payable within 30 days of the invoice date, without discount or setoff, to our bank
- Default: Failing to pay on time places you in default automatically. Statutory interest accrues from the due date. If you face liquidation, bankruptcy, or debt restructuring, all sums become immediately payable.
- Invoice Disputes: Disputing an invoice does not suspend payment. Payments first cover accrued interest/costs, then the oldest unpaid invoice.
- Credit Assessment: We may check your creditworthiness. If justified, we can refuse an order or apply special terms. We can also request a deposit or other security before delivery; refusal is a breach.
- Invoice Complaints: Written objections must be lodged within 30 days of the invoice date. Otherwise, we assume acceptance. If you have paid, we consider you to have agreed with its contents.
- Collection Costs: If you are in default, you will be responsible for any applicable late fees, interest, and collection costs as permitted under the US Fair Debt Collection Practices Act (FDCPA). We reserve the right to recover reasonable legal fees in the event of a dispute.
Article 8: Changes in Products or Circumstances
- Minor Modifications: We may make minor improvements required by law or beneficial to product quality, provided they do not alter essential features.
- Significant Changes: If unexpected factors emerge—unknown at the Agreement’s inception—either party may request modifications for fairness. Additional costs due to your actions are billed to you.
- Address Updates: You must inform us of address changes in writing immediately. Deliveries to your last known address are deemed delivered.
Article 9: Cancellation, Return Shipment, and Right of Withdrawal
- Cancellation Costs: Canceling (in whole or part) before delivery obligates you to reimburse our reasonable costs and any direct or indirect damages. Personalized/custom orders cannot be canceled once production starts, unless we agree in writing.
- Last-Minute Cancellation: If you cancel within two weeks of the agreed delivery date, you owe the full invoice amount.
- Return Requirements: Returns need our written consent and are generally refused if Products are damaged, used, or not in original packaging, or if more than 30 days have passed. Special-condition or custom items are also excluded.
- Your Confirmation: You must confirm no prohibitions apply when requesting a return. We decide if the Products qualify for credit, exchange, or rejection based on their condition upon arrival.
- US Consumer Returns & Right of Withdrawal: If you are purchasing from the United States, our refund and return policies comply with applicable federal and state laws. Consumers in states that mandate return policies (e.g., California) may be entitled to additional rights.
If applicable state or federal laws provide greater return rights than those stated here, those laws take precedence. Unless legally required otherwise, returns must comply with the conditions outlined in these Terms.
- Shipping Costs: Additional shipping or handling fees may apply if the Product is returned from outside our usual service areas.
Article 10: Suspension and Termination
- Immediate Grounds: We may suspend or terminate the Agreement if:
- You breach essential terms and fail to fix the issue within 7 days of notice.
- You face bankruptcy, liquidation, or substantially cease business.
- Your finances deteriorate significantly, risking non-payment.
- You fail to provide required security or breach payment terms.
- Consequences: We can claim damages and demand immediate payment of all outstanding invoices plus interest. Termination does not affect accrued rights predating termination.
Article 11: Retention of Title
- Ownership: We retain ownership of all delivered Products until you settle all obligations under any Agreement with us. Title passes only after all payments are completed.
- Right to Repossess: If you fail to meet obligations or if we suspect non-compliance, we may reclaim the Products still under retention of title. You must fully cooperate.
- Third-Party Claims: You must inform us promptly if a third party attempts to seize or claim rights over our retained Products.
- Insurance and Protection: We may require you to insure the Products, assign any insurance claims to us, label them as our property, and assist in protecting our ownership rights.
Article 12: Conformity, Inspection, and Complaints
- Basic Quality: We ensure Products meet usual requirements for normal use at delivery. Natural materials (like wood) may shift or crack, which is not considered a defect.
- Inspection on Receipt: Upon delivery, verify that the Products match the Agreement in type, quantity, and condition, and note any visible damage.
- Visible vs. Non-Visible Defects: Report visible defects in writing within 14 days of delivery; non-visible defects within 14 days of discovery (but not beyond 3 months). Late reporting may forfeit your rights.
- Minor Variations: Small color or size variations do not justify a complaint. If a complaint is valid, we may offer a refund, price reduction, repair, or replacement.
- Obligations During Complaints: Even with a timely complaint, you must still pay and accept the Products unless we agree otherwise. Returns are only possible with prior written approval.
Article 13: Prices and Price Increases
- Sales Tax: Quoted prices generally exclude sales tax unless clearly stated otherwise.
- Price Adjustment: Within 3 months of the Agreement, we may raise prices only if required by law. You may cancel within 14 days if that occurs. After 3 months, we can adjust prices for market or cost reasons.
Article 14: Liability and Indemnification
- Scope of Liability: We are liable only for direct damages caused by our gross negligence or willful misconduct, subject to the limits in this article.
- No Indirect Damages: We are not liable for indirect or consequential damages (e.g., lost profits, business disruption). For Consumers, these limitations apply as far as Dutch law permits (Article 7:24(2) BW).
- Indemnification by You: You indemnify us against third-party claims not directly caused by us. We are not responsible for any damage that occurs under your control or someone else’s.
- Liability Cap: Our liability is capped by our insurer’s payout. If the insurer does not pay, it is limited to the invoice value of the relevant Product.
- Exemptions: We are not liable for force majeure events (Article 15), nor for damages arising from usage at festivals or similarly uncontrolled environments.
- US Consumer Protections & Liability Limitations: If you are a Consumer in the United States, certain limitations of liability in this Agreement may not apply in states where such disclaimers are restricted (including but not limited to California, New York, Texas, and Florida).
Subject to applicable federal and state law, our Products are provided “As-Is” and “With All Faults” unless otherwise required by law. Certain states, including California, New York, and Texas, may prohibit disclaimers on implied warranties or product fitness for a particular purpose.
Magnuson-Moss Warranty Act Notice: If you purchase a warranted Product in the United States, your warranty rights are governed by the Magnuson-Moss Warranty Act, which may entitle you to specific legal rights in addition to the warranty terms stated here.
Article 15: Force Majeure
- Definition: Force majeure includes unforeseen events beyond our control—strikes, raw material shortages, natural disasters, government actions, etc.—that make performance impossible or unreasonably burdensome.
- Post-Obligation Invocation: If these conditions arise after we should have delivered, we can still invoke force majeure. We may suspend or cancel obligations without liability for damages.
- Partial Performance: If we partially fulfilled obligations before force majeure, we may invoice for that portion. Force majeure affecting our suppliers also counts as force majeure for us.
Article 16: Intellectual and Industrial Property
- No Removal of Notices: You may not remove or alter any trademarks, copyrights, or other proprietary labels from our Products or materials.
- Prohibition on Imitation: Imitating or reproducing our products/designs is banned, as is providing them to third parties who might replicate them.
- Penalties: Breaching these prohibitions incurs a fine of 5% of the Product’s purchase price (min. $500 per item). You must enforce this through a chain clause on your successors.
Article 17: Health & Safety Disclaimers
- No Medical Advice: We do not offer medical advice. If you have heart conditions, are pregnant, take medication, or have health concerns, consult a professional before using an Icetub or IceSauna.
- Age Restrictions: Our Products are not recommended for minors without direct adult supervision. An adult should be aware of potential risks before allowing a minor to use the Product.
- Setup & Maintenance: You must ensure installation complies with local electrical/building codes. If unsure, hire qualified professionals to avoid safety hazards.
- Heat/Cold Sensitivities: Prolonged or extreme temperature exposure can be dangerous. Stop using the Product if you feel dizzy, faint, or unwell, and seek medical help if needed.
- US Consumer Product Safety Notice: Our Products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.
Claims regarding health benefits of the Icetub or IceSauna are based on general wellness and fitness principles, not on FDA-approved studies.
If you have pre-existing health conditions, consult a physician before use.
FTC Advertising Disclosure: We comply with US Federal Trade Commission (FTC) guidelines regarding advertising claims. Any statements about health benefits are intended for general informational purposes only.
Article 18: Personal Injury Waiver / Assumption of Risk
- Inherent Risks: By using our Icetub or IceSauna, you acknowledge there are inherent risks, including—but not limited to—slipping, falling, heat/cold stress, fainting, or shock. You voluntarily assume these risks.
- Immediate Cessation of Use: If you experience any adverse symptoms (e.g., shortness of breath, dizziness), stop use immediately and seek medical advice.
- Minor Supervision: If minors are allowed to use the Product (e.g., in a family setting), direct supervision by a responsible adult is mandatory.
- Disclaimer of Liability: Subject to applicable law, we are not liable for personal injuries resulting from your improper, unsafe, or negligent use of the Product. This includes failure to follow recommended instructions and guidelines.
Article 19: Privacy
- Data Processing: We process personal data (for orders, deliveries, etc.) in accordance with the GDPR and our Privacy Statement at icetubs.com/privacy-statement.
- Policy Updates: We may update our Privacy Statement; changes take effect upon communication. We encourage you to review it periodically.
Article 20: Final Provisions
- Amendments: We can amend these Conditions at any time. Changes take effect on the date communicated or upon notification if no date is specified. If you are a Consumer and a significant amendment harms your rights, you may dissolve the Agreement under Article 6:237(c) BW.
- Exclusion of Certain Articles: Articles 7:404, 7:407(2), and 7:409 of the Dutch Civil Code do not apply.
- Legal Claims: All legal claims expire 1 year after they arise. Only Dutch law applies. The Vienna Sales Convention is excluded.
- Dispute Resolution: Consumers in the United States may bring legal proceedings in either Dutch courts or the courts of their state of residence, subject to mandatory local legal protections.
- Version Control: The latest version or the version valid at the time the legal relationship started applies.
- Legal Jurisdiction: These Terms are governed by Dutch law, except where US federal or state laws provide mandatory consumer protections. In the event of a conflict between these Terms and applicable US consumer laws, the latter shall take precedence.
